9780199685400: The Sources of International Law
Présentation de l'éditeur :

The question of what is, and what is not, part of international law is fundamental in shaping its current form and its development. Traditionally, treaties between states and state practice were seen as the primary means with which to create international law. However, the definition of what the sources of international law are, and how they operate, has been questioned in significant ways. Particularly this has been seen in the more recent developments in the notion of customary international law, which stands alongside international treaties and instruments as a key foundation upon which international law is built. This book provides a key inquiry into all the recognised, or asserted, sources of international law. It investigates the impact of ethical principles on the creation of international law; whether 'soft law' norms come into being through the same sources as binding international law; and whether jus cogens norms, and those involving rights and obligations erga omnes have a unique place in the creation of international legal norms. It studies the notion of 'general principles of international law' within international law's sub-disciplines, and the evolving relationship between treaty-based law and customary international law. Re-examining the traditional model, it investigates the increasing role of international jurisprudence, and looks at the nature of international organisations and non-state actors as potential new sources of international law. The book provides a perfect introduction to the law of sources, as well as innovative perspectives on new developments, making it essential reading for anyone studying or working in international law.

Revue de presse :

It can hardly be contested that SIL constitutes a splendid and comprehensive cartographic exercise that offers a snapshot of where the doctrine of the sources of international law stands... SIL [is] destined to be the new authoritative compendium on the sources of international law and reach the pantheon of the classics of intentional law shortly. ( Jean dAspremont, German Yearbook of International Law)

It is an up-to date, major and valuable attempt to tackle the doctrine of sources and related doctrines at the time of complex developments that at times place these doctrines under strain. It should be read and engaged widely by scholars, students and practitioners to identify the major points of underlying debates. ( Alexander Orakhelashvili, The British Yearbook of International Law)

Description du livre Oxford University Press, United Kingdom, 2014. Paperback. État : New. 232 x 154 mm. Language: English . Brand New Book. In recent years States have made more and more extensive use of the International Court of Justice for the judicial settlement of disputes. Despite being declared by the Courts Statute to have no binding force for States other than the parties to the case, its decisions have come to constitute a body of jurisprudence that is frequently invoked in other disputes, in international negotiation, and in academic writing. This jurisprudence, covering a wide range of aspects of international law, is the subject of considerable ongoing academic examination; it needs however to be seen against the background, and in the light, of the Courts structure, jurisdiction and operation, and the principles applied in these domains. The purpose of this book is thus to provide an accessible and comprehensive study of this aspect of the Court, and in particular of its procedure, written by a scholar who has had unique opportunities of close observation of the Court in action. This distillation of direct experience and expertise makes it essential reading for all those who study, teach or practise international law. N° de réf. du libraire AOP9780199685400
