The British asserted that Russia had never enforced exclusive jurisdiction over the sea. Rather, they argued that Russia only claimed sovereignty over land territory in Alaska. The primary evidence for this argument was the fact that the Russian government had never officially notified foreign powers about the supposed ban on hunting and fishing in the Bering Sea.
