Synopsis

Design and build contracting has increased enormously since the JCT published their first design and build form in 1981. Impetus was given to this by the issue of the second edition of the ACA Building Agreement in 1984, which can be used for design and build, and by the BPF manual which introduces a system imposing design liability on the contractor. This book considers the legal aspects of design and build contracts and looks at their practical applications on site.

The Joint Contracts Tribunal issued a new Design and Build Form in2005, a successor to the JCT Standard Form of Building Contractwith Contractor s Design. It looks substantially differentfrom its predecessor and it is different in structure and often inits wording.

The Author

David Chappell BA(HonsArch), MA (Arch), MA (Law), PhD, RIBA has 45years experience in the construction industry, having workedas an architect in the public and private sectors, as contractsadministrator for a building contractor, as a lecturer inconstruction law and contract procedures and, for the last twentyyears, as a construction contract consultant . He is currently theDirector of David Chappell Consultancy Limited and frequently actsas an adjudicator. He was Professor and Senior Research Fellow inArchitectural Practice and Management Research at The Queen sUniversity Belfast and Visiting Professor of Practice Managementand Law at the University of Central England in Birmingham. DavidChappell is the author of many articles and books for theconstruction industry. He is one of the RIBA Specialist Advisorsand lectures widely.
