The beginning fort he embracing of Byzantine legal sources by the greatest French jurist! Jacques Cujas, Rechtslehrer an verschiedenen französischen Universitäten, hauptsächlich an der bedeutenden Reformuniversität zu Bourges, bedeutendster französischer Jurist, hatte über Jahrhunderte maßgebend mit seinen Werken auf die Entwicklung des Zivilrechts in Europa beeinflusst. Besondere Bedeutung hatte Cujas als Gräzist erlangt, verfasste epochale Schriften über die Graeca in Pandectas. Die Bedeutung der Basiliken, die in 60 Büchern ins Griechische übertragene Corpus iuris civilis, erkannte Cujas und zeigte nachhaltig die Bedeutung der Basiliken gerade für das Verständnis des lateinischen Corpus iuris civilis. Die Übersetzung des Buches LX der Basiliken war ein glänzender Anfang für die Hinwendung zu den byzantinischen Rechtsquellen. Diese Übersetzung der Basiliken und auch die Arbeiten zum Codex Theodosianus fanden keinen Eingang in die opera-omnia-Ausgabe von Cujas. The works of the most important French jurist Jacques Cujas, teacher of law at various French universities, mainly at the leading Reform University of Bourges, had a major influence on the development of civil law in Europe for centuries. Cujas gained particular importance through his seminal writings on the graeca in the pandectae. The significance of the basilica, the 60 books of the Corpus iuris civilis in Greek, was grasped by Cujas who thus secured the lasting importance of the basilica especially for an understanding of the Latin Corpus iuris civilis. The translation of Book LX of the basilica was a glorious beginning for the embracing of Byzantine legal sources. Dort schrieb er die ersten Bücher seines großen Werkes: Observationes et emendationes, seines opus incomparabile. Im Jahre 1556 erschien das erste Buch seines Lebenswerkes: observationes et emendationes, das 1595 postum mit dem liber XXVIII (1585 zu Lebzeiten mit liber XXIV) abgeschlossen wurde. Das Werk, welches seines Gleichen noch nicht gefunden hat" (Spangenberg), und drei Jahre nach der Veröffentlichung des Codex Florentinus 1553 durch die Editio Taurelliana begonnen wurde, beschäftigt sich in einem solch hohen Maß an Gelehrsamkeit mit den justinianischen Rechtsbüchern, insbesondere den Digesten, das ihm der Titel opus incomparabile verliehen wurde. Erstmals werden durch Cujas die byzantinischen Rechtsquellen, insbesondere die Basiliken herangezogen, die Glossa ordinaria von Accursius (um1185-1263) wird häufig verbessert, der Codex Florentinus als maßgebende, jedoch nicht als alleinige Rechtsquelle angenommen. Insgesamt sucht Cujas nicht nur die Rekonstruktion des justinianischen Urtextes, das Ziel aller Textkritik, sondern will weit darüber hinaus die ratio iuris als das neben der scriptura mitentscheidende Kriterium verstanden wissen. Das iudicium eruditorum soll die Leitlinie innerhalb der gesamten Rechtswissenschaft auch der Textkritik sein (Troje). Das Werk wurde nochmals mit einer Vorrede von dem bedeutendsten deutschen Juristen des 18. Jahrhunderts Johann Gottlieb Heineccius (1681-1741) im Jahre 1737 in Halle gedruckt, durch Verbesserungen in den Allegationen im Gebrauch wesentlich verbessert. The author was a French jurist and scholar of Roman law. He taught at Toulouse, Bourges, and elsewhere. Unlike previous scholars, he was relatively unconcerned with the practical applications of Roman law and wished primarily to study the ancient texts in their relation to history and literature. He is often considered the founder of the historical school of jurisprudence.

Im Kreise der europäischen, vor allem französischen Juristen des 16.Jahrhunderts, die sich den Forderungen einer humanistischen Bildung und Wissenschaft, einer humanistischen Forschung und Lehre stellen, ist Jacques CUJAS (1522-1590) die überragende Gestalt. Mitz Jacobus CUIACIUS wird die humanistische Rechtswissenschaft für zwei Jahrhunderte in Europa führend. Seine Editionen, Exegesen und Theorien beherrschen die zivilistische Praxis. Die Universalität seiner Quellenkenntnis, die Weite seines Bildungshorizonts und die Eindringlichkeit sowie Kühnheit seiner Interpretationen und dogmatischen Lösungen sind unübertroffen. "Tota Europa solus legum interpres" nannten ihn bereits die Zeitgenossen mit vollem Recht. CUJAS war die wirkungsreichste Juristengestalt bis zum 18.Jahrhundert, anerkannt auch unter den Gegnern der humanistischen Jurisprudenz und wie die Edition beweist, auch im Mutterland der scholastischen Jurisprudenz ein vielgefragter Ratgeber. Unter dem Einfluß von Carl Friedrich von Savigny und seiner historischen Rechtsschule schwand der Bekanntheitsgrad von Cujas zusehends. Grund war der wissenschaftlich nicht haltbare Vorwurf, Cujas habe das "justinjanische" Recht vernachlässigt zugunsten des vorjustinjanischen, klassischen Rechts. Mit der neuen Blüte der Interpolationsforschung wurde dieses Bild korrigiert, der Name CUJAS hat in der modernen Forschung wieder jenen Klang erhalten, der über Jahhrhunderte erklang. Mit einem ganzseitigen Portrait von Jacques Cujas. 10 Halbleinen-Bände. CUJAS, Jacques (1522-1590), hochgelehrt und hochgeschätzt, war der bedeutendste französische Jurist. Cujas studierte in seiner Geburtsstadt Toulouse Rechtswissenschaft und hielt ab 1547 Vorlesungen zu den Justinianischen Institutionen. 1554 bewarb er sich dort erfolglos um den Lehrstuhl für römisches Recht. Der Widerstand gegen Cujas war vor allem von Jean Bodin (1529/30-1596) organisiert, der die neue Lehrmethode des mos gallicus ablehnte. Cujas wandte sich ins nahegelegene Cahors, wo er die Professur von Antonius Goveanus (1505-1566) übernahm. Cujas verließ diese Universität nach nur neun Monaten, weil ihn im Juli 1555 der Ruf an die damals berühmteste Rechtsfakultät Europas in Bourges erreichte. Dort wurde er Nachfolger auf dem Lehrstuhl von Francois Baudouin (Franciscus Balduinus, 1520-1573), der sich aus religiösen Gründen gezwungen sah, Frankreich zu verlassen. Cujas war in Bourges der Konkurrenz von Hugo Donellus (1527-1591) und Franciscus Duarenus (1509-1559) ausgesetzt. Diese veranlassten während einer Pariser Bibliotheksreise von Cujas in den Monaten April bis Juni 1557 die Studenten, Bittschriften an den städtischen Magistrat einzureichen, um eine Rückkehr Cujas zu verhindern. Bei seiner Ankunft war die Unruhe in Bourges schon so groß, dass er die Stadt verließ und eine Professur in Valence annahm. Dort schrieb er auch die ersten Bücher seiner observationes et emendationes, seines opus incomparabile. Nach dem Tode von Duaren 1559 kehrte Cujas nach Bourges zurück. 1566 wechselte er an die Universität von Turin, die damals in französischem Besitz war. 1567 nahm er einen Ruf an die Universität von Valence an, die durch die Vereinigung mit der Universität Grenoble erheblich an Bedeutung gewonnen hatte. Überraschenderweise kehrte Cujas im Juni 1575 an die Universität Bourges zurück, obwohl ihm eine Vertragsverlängerung zu glänzenden Bedingungen in Valence angeboten worden war. Möglicherweise bewegten ihn aufkeimende Auseinandersetzungen zwischen Protestanten und Katholiken zur Rückkehr ins rein katholische Bourges. Seine großen Rivalen Donellus und der Nachfolger von Duaren Francois Hotman (1524-1590) waren nach der schrecklichen Bartholomaeusnacht 1572 aus Bourges geflüchtet. Dort starb Cujas am 4. Oktober 1590. Sein Haus in Bourges ist heute Museum. Sein Gesamtwerk (opera omnia) sollte Grundaustattung jeder rechtshistorischen Bibliothek sein. Im Jahre 1577, Cujas war 55 Jahre alt, erschien bei Sebastian Nivellius in Paris in fünf Foliobänden erstmals seine Opera omnia: de iure fecit in hunc diem, von Cujas selbst zusammengestellt und redigiert. Seine berühmten Observationes hatten gerade das Buch 20 erreicht. Der Verkauf war so erfolgreich, daß eine Nachdruck in den Jahren 1583-84 erschien. Im Jahre 1658 wurde das Gesamtwerk von Cujas seine opera priora (zu Lebzeiten erschienene, Bände 1-3) und die opera posteriora (opera postuma) in 10 Bänden Annibal Fabrot neu geordnet. Diese Opera omnia wurden Grundlage und Druckvorlage aller späteren Gesamtausgaben von Cujas. His wanderings were partly prompted by civil and ecclesiastical disturbances. He diligently sought and examined manuscripts and studied his materials historically, comparatively, and critically. His works, notes on the Institutes ans Paul`s Sententiae, commentaries on various titles of the Digest, and Observationes, won for him the reputation of the leading jurist of the day. Other writings seek to restore the text and form of, and establish the meaning of, the classical jurists whose works are excerpted in the Digest. He also published amended texts of the works previo.
