The Houmas claim was a 188,216 acre tract stretching from the Mississippi to the back swamps, attracting land speculators and inspectors. Disputes over title of the property become embroiled in two congressional investigations culminating in the longest legal battle in American jurisprudence.

George Bibb is the first of nine "undersigned counsellors and attorneys at law, admitted as practitioners in the court of the United States, for the seventh Circuit and Kentucky district." John J. Crittenden [Governor, U.S. Senator, U.S. Attorney General] is among the signers. They offer suggestions to improve the administration of the Supreme, Circuit, and Kentucky courts. Docketing schedules require Judges "to adjourn the Supreme Court, to attend the circuits, leaving from sixty to seventy cases on the docket uncalled. . . Very many of the cases now on docket have been standing there for eight years untried." Additionally, circuit-riding requirements place unreasonable travel burdens on the Judges. Six states "are without the benefit of the circuit system. In those six states the opinion of the single District Judge is final and without appeal" in many cases. Bibb and his colleagues also criticize the use of Supreme Court judges to determine circuit court cases. Pages are age toned, foxed and soiled throughout. All pages are present and readable, including index. This copy bears the original bookplate of Judge John Trimble of Paris, Kentucky (bio below). A nice copy of this SCARCE work and an early Kentucky imprint with fantastic legal provenance. Not Ex-Lib. Judge John Trimble Although Judge Robert Trimble lined up with the Anti-Relief Party, a new Court of Appeals was created by the Relief Party, and the conflict continued under the names of the Old Court and New Court parties. The New Court included such well-known names as George M. Bibb, Wm. T. Barry, John Rowan, John Trimble and others. This Judge John Trimble was born in Kentucky, December, 1783. When a youth of nineteen he served at the pioneer town of Vincennes, Indiana, as secretary to the territorial Governor. Upon his return to Kentucky he also studied law like his gifted relation, Robert Trimble, under George Nicholas. He practiced in the courts of Paris, Kentucky and rose to the Circuit Bench. Judge John Trimble was appointed to New Court of Appeals by Governor Desha. It seems that the excitement and distress all around him became so discouraging that he resigned his position not very long after. The Legislature, who created the New Court of Appeals had been unable under the constitution to remove the judges of the Old Court, so a law was passed repealing the act by which the Old Court had been organized. This enactment was put through in perhaps the most exciting session of the Kentucky legislature ever known. The Old Court absolutely refused to be abolished; and the greater part of the legal profession and state judiciary stuck to the Old Court. The New Court, however, held its sessions and was recognized by a substantial part of the lawyers and judges over the state. Meanwhile the poor and distressed masses of the people through ballots had given such overwhelming majorities for the relief in the legislature, began to emigrate westward in such numbers that by the next election the Old Court party came to power again. Records of the time revealed how steady was the stream of people to other states and territories. In the year 1820, Thomas H. Benton, the United States Senator from Missouri appeared in public life with the profound sympathy for the struggling masses. Thousands of the Revolutionary veterans had drifted westward in utter destitution; for it is said that if all thosse who were burdened with debt in one single New England State had been imprisioned for it, two-thirds of the population, including the old soldiers would have been behind the bars. The famous Col. Barton who captured Colonel Prescot, languished in prison for a debt of the sort. And Senator Thomas H. Benton gives us in the opening of his great book, "Thirty Years in the U.S. Senate, " a graphic picture of conditions.

The interpretation of this legal issue had profound consequences for Kentucky's citizens. After the Panic of 1819, Kentucky enacted Relief Laws which stayed the payment of debts and required lenders to accept payment in notes of the new, uncapitalized Bank of Kentucky. Lenders who refused would endure lengthy delays before payment, if ever. Bibb-- who had been Kentucky's Chief Justice and would become a U.S. Senator-- argues that the Relief Laws do not impair the obligation of contracts, that they are thus constitutional, and that it is the Legislature's duty to define what the obligations of those contracts are. His discussion of the constitutional questions is learned and highly detailed. Kentucky's future Jacksonians, like Amos Kendall and William Barry, stood with the Relief Party, blaming the Bank of the United States for the Panic. For a sketch of Bibb's life, see DAB.
