Italienische Ausgabe desd Institutionenkommentars von Mynsinger, dem Begründer der Literatur zum Reichskammergericht! Joachim Mynsinger von Frundeck (1514 - 1588) studierte in Freiburg im Breisgau, wohin ihn der berühmte Ulrich Zasius zog. Mit diesem stand er dann bis zu dessen Tode am 25. November 1535 in sehr enger, ja freundschaftlicher Beziehung. Mynsinger war ein jugendlicher und kecker, bisweilen frecher Doktor der Jurisprudenz, der immer wieder mit den altehrwürdigen Traditionen der Juristenfakultäten in Konflikt geriet. Bereits im Jahre 1536 erwarb er sich die Erlaubnis, über die Institutionen Vorlesungen zu halten. Jedoch immer wieder legte er sich mit der altehrwürdigen Alma Mater an und bekam mehrfach einen Verweis wegen seines Äußeren beispielsweise wegen des Verstoßes gegen die Kleiderordnung oder gegen das Verbot des Degentragens. Nachdem sich der erste jugendliche Sturm gelegt hatte und nach heftiger Intervention seines Vaters erhielt er 1543 die Professur für den Codex. Im Jahre 1548 ging Mynsinger aus Freiburg weg und wurde Beisitzer am Reichskammergericht. Im Jahre 1576 erhielt er einen Ruf an die neugegründete Universität Helmstedt. Dies erklärt eine Reihe von Druckausgaben aus Helmstedt.

Joachim Mynsinger (1514-1588) kann als eigentlicher Begründer der Kameralistik angesehen werden. Durch die Verletzung der Geheimhaltungspflicht bezügl. der Entscheidungsgründe am Reichskammergericht schuf er den Prototyp der Entscheidungsliteratur in Deutschland. Seine "singularium observationum imperialis camerae centuriae" waren ursprünglich eine Edition seines eigenen Zettelkastens, den er für seine Tätigkeit am RKG verfaßt hat. Zunächst 1563 als schmaler Band ediert, wuchs es bald durch seinen enormen Erfolg zu einem stattlichen Band, der mehr die Eintscheidungen des RKGs zum Gegenstand hatte. Diese Ausgabe ist neben der venezianischen der einzige ausländische Druck, eine Seltenheit unter den vielen Ausgaben des Mynsingerschen Werkes. 1514: geboren am 13. Sehr frühe VENEZIANISCHE AUSGABE des Institutionenkommentars von Mynsinger! Seit 1555 erschien der Institutionenkommentar von Joachim MYNSINGER von Frundeck (1514-1588), zu dieser Zeit Professor der Rechte an der Universität Freiburg im Breisgau, unter dem Namen APotelesma in regelmäßigen Abständen. Zuvor war ein kleiner Institutionenkommentar im Jahre 1545 erschienen. Zu dieser Zeit war Mynsingere bereits Assessor am Reichskammergericht, dem höchsten deutschen Zivilgericht und letzte Instanz in Deutschland. Im Jahre 1587, Mynsinger war zu dieser Zeit Professor der Rechte an der neugegründeten Universität von Helmstedt, erschein die erste italienische Ausgabe in venedig (vgl. Coing Handbuch II,1/526: dort wird nur eine Venezianische Ausgabe von 1606 genannt). Der Institutionenkommentar erfuhr nach dem Tode von Mynsinger unter der Bearbeitung von Arnold de Reyger eine europaweite Verbreitung: Ausgaben erschienen in Genf (1609 und 1633), in Antwerpen (1642), Lyon (1678) und Douai (1678). Die Venezianische Ausgabe ist wie die berühme Venezianische Editioon des Institutionenkommentars von Schneidewin eine bereinigte Ausgabe: repurgatus. Dort werden alle der katholischen Lehre widersprechenden Stellen, insbesondere im Ehrecht eliminiert, damit die katholische Zensurbehörde den Druck genehmigt. Wie bei Hotman ist auch der Kommentar am Gesetzestext der Institutionen Justinians ausgerichtet. Zum jeweiligen Stichwort erfolgen im Apparatus criticus umfangreiche Erläuterungen.

(Stuttgart, 13 agosto 1514 - Helmstedt, 3 maggio 1588) fu celebre giurista riformato, la cui opera fu messa all Indice. I Paesi tedeschi erano i centri dell "infezione" luterana, e la vigilanza doveva essere applicata soprattutto a quelle opere di cui maggiore era la pericolosità, perché trattanti di usura, questioni matrimoniali (uno dei cardini della nuova legislazione tridentina), giurisdizione temporale del papa. Joachim Mynsinger von Frundeck (1514 - 1588) studierte in Freiburg im Breisgau, wohin ihn der berühmte Ulrich Zasius zog. Mit diesem stand er dann bis zu dessen Tode am 25. November 1535 in sehr enger, ja freundschaftlicher Beziehung. Mynsinger war ein jugendlicher und kecker, bisweilen frecher Doktor der Jurisprudenz, der immer wieder mit den altehrwürdigen Traditionen der Juristenfakultäten in Konflikt geriet. Bereits im Jahre 1536 erwarb er sich die Erlaubnis, über die Institutionen Vorlesungen zu halten. Jedoch immer wieder legte er sich mit der altehrwürdigen Alma Mater an und bekam mehrfach einen Verweis wegen seines Äußeren beispielsweise wegen des Verstoßes gegen die Kleiderordnung oder gegen das Verbot des Degentragens. Nachdem sich der erste jugendliche Sturm gelegt hatte und nach heftiger Intervention seines Vaters erhielt er 1543 die Professur für den Codex. Im Jahre 1548 ging Mynsinger aus Freiburg weg und wurde Beisitzer am Reichskammergericht. Im Jahre 1576 erhielt er einen Ruf an die neugegründete Universität Helmstedt. Dies erklärt eine Reihe von Druckausgaben aus Helmstedt. Mit den Beobachtungen zur Rechtsprechung des Reichskammergerichts wurde Mynsinger einer der Mitbegründer der kameralistischen Literatur und gewann unter den Kameralisten nach Andreas Gail (1526 - 1587) das höchste Ansehen. Die Erstausgabe erschien im Jahre 1563 in Basel. Schöner, zeitgenössischer Holzdeckelband mit blindgeprägtem Schweinslederüberzug auf vier Bünden geheftet, hinterer Buchdeckel gebräunt.

In folio (cm 22,1 x 33,5), bellissima legatura piena pelle di scrofa coeva, assai ben conservata, vera e propria scultura ornata di minuziosi ceselli: le sedici figurine per piatto dell'Antico e del Nuovo Testamento: Davide con l'arpa, Pietro. ogni personaggio con in calce il proprio motto, gli ornamenti e i fregi di ogni genere -qui il leit-motiv ? dato dalle ghiande, presenti in numero di ventiquattro. Al frontespizio, splendida impresa dell'Episcopius: mano vescovile regge pastorale, che reca in cima cicogna con il sassolino nella zampa, simbolo di vigile attesa; circondato da ricca cornice silografica allegorica. L'impresa ? ripetuta, con varianti, al verso dell'ultima carta, a piena pagina. Al verso del frontespizio, grande stemma araldico della famiglia Frundeck. Ms. casemarks to front pastedown, C18 1 Julii 1717 to first t-p. In a solid, handsome pigskin binding. The centrepieces are signed G.K. (Georg d. Ä. Kammerberger, EBDB w000435 and Haebler I 221-225). The Kammerbergers were a family of bookbinders, whose workshops in Wittenberg were active during a large part of the C16 and throughout the C17 century. The company probably flourished under Georg Kammerberger the Younger in the 1590s, who was elected Master of the Guild in 1592 (Haebler). This binding is stamped with the finely cut arms of Christian I, Elector of Saxony, and those of Johann Georg, Elector of Brandenburg. Christian I married Sophie of Brandenburg, Johann Georg s daughter, in 1586; after her husband s death in 1591, she became Regent (Sophia Electrix) during the minority of their son, until 1600. Given that, during the Regency, her personal arms were used in escutcheons and medals, this binding was probably produced for her library in the preceding years, with the Saxon and Brandenburg arms identifying her status as wife and daughter. Two important commentaries to Justinian s Institutiones a cornerstone of the Western legal system. Justinian I (482-565) ruled for forty years over the Byzantine empire and succeeded in temporarily rekindling the former splendour of Rome by reclaiming Italy, Dalmatia and Spain from the Ostrogoths and Visigoths. Institutiones is part of his Corpus iuris civilis , the first codification of Roman law. Based on the Institutiones of Gaius, and other authorities, including Ulpian, it is a compendium of the basic institutions of Roman law devised by Theophilus and Dorotheus, two Byzantine law professors, under the supervision of Tribonian. François Hotman (1524-90) was a French Protestant lawyer associated with the anti-absolutist faction. In his revolutionary Anti-Tribonian , he advocated the substitution, in France, of Roman law based on Justinian, a change the king could have enforced with a legislative act. With a philological approach, he favoured an alliance between law and history in order to distinguish between old law and new law , that is, between obsolete law and authoritative law , being concerned with salvaging what still had practical value among Roman laws (Kelley, François Hotman , 189). His Commentarius , also featuring a life of Justinian, sought to highlight Roman laws still relevant to the present, distinguishing originals and interpolations by later jurists, including the berated Tribonian. Joachim Mynsinger von Frundeck (1514-88) was a German jurist and writer, a judge at the Imperial Chamber of Justice in Speyer and later Vice-Chancellor of Helmstedt University.
