Jahrhunderts wird als klassische Jurisprudenz der Prinzipatszeit bezeichnet. In dieser Zeit erlebte das Ius Romanum jene Hochzeit, die dann wesentlich Eingang gefunden hat im Corpus iuris civilis. Das Ius Romanum, auch dessen Wissenschaft ist im wesentlichen kasuistisch, auch seine Kommentare und Systeme sind kasuistisch. Diese Kasuistik, die keinesfalls spitzfindig oder formelhaft, sondern lebendig-praktisch sich uns bietet, ist intensiv bestrebt, den Reichtum und die Mannigfaltigkeit des wirklichen Lebens zu erfassen und zu beherrschen. Der römische Jurist nannte diese Kunst die ars boni et aequi. Die Schriften dieser klassischen Juristen fanden breiten Eingang in die Digesten des Corpus iuris civilis, jedoch auseinandergerissen, verkürzt, teilweise verändert. Eine Darstellung der klassischen römische Jurisprudenz bietet die Palingenesia von Otto Lenel. Die Digesten bestehen bekanntlich großteils aus excerpierten Klassikerstellen, die in bestimmter Ordnung in den einzelnen Titeln der Bücher angeordnet sind. Alle diese Exzerpte aus Klassikerschriften sind durch Herkunftsangaben in den Inskriptionen der Fragmente gekennzeichnet. Ein mechanisches Aneinanderreihen der in den Fragmenten angezeigten Inskriptionen müsste zu den wiederhergestellten Schriften der römischen Klassiker führen. Doch auch in die Inskriptionen haben sich beim Zusammenstellen der Digesten Fehler eingeschlichen. Beim Aufsuchen des ursprünglichen Zusammenhangs muß der Inhalt des einzureihenden Fragments ausschlaggebend sein. Dies musste kritisch geprüft sein. Die Feststellung der Materienfolge ist wohl die schwierigste und anspruchsvollste Arbeit, die Otto Lenel im Gegensatz zu den Vorversuchen, etwa der Palingenesia von Karl Ferdinand Hommel (1722-1781) geleistet hat. Hinzukommt das Aufdecken Justinianischer Interpolationen. Diese philologischen Arbeiten sind nicht mehr steigerbar. Otto Lenel, der in der Pandektenwissenschaft ausgebildet wurde, ist keiner Schule zuzuordnen. In seinem Lebenswerk, die Wiederherstellung der Schriften der klassischen römiscshen Juristen, war er ein Pionier und hat dem Archetypus aller europäischen Rechtswissenschaft ein ewiges Denkmal errichtet. 1849: geboren am 13. Dezember in Mannheim als Spross einer angesehenen jüdischen Kaufmannsfamilie, sein Vater war Vorsitzender der Handelskammer 1865: Beginn des Rechtsstudiums in Heidelberg, Professor für römisches Recht war Vangerow, den er als zu theoretisch kritisierte, auch wenn seine Vorlesungen Ihm den Weg zum Ius Romanum öffneten 1867: Wechsel nach Leipzig zu C. Hardcover. 662; 657 pp. 30 cm. - Otto Lenel (1849-1935) is best known for his reconstruction of the fundamental text of the Roman legal system, the so-called edictum perpetuum of the Roman praetors. The praetors were the government officials responsible for the administration of justice during the Roman republic and the principate (509 BC - 284 AD). The edictum (or edict) was the text in which the newly elected praetor announced how he would handle his responsibilities. More precisely, the edict announced, under what circumstances it would succeed and when it would fail. Originally, every praetor drafted his own edict, but over time, a standard text was established, which was regularly re-enacted by the new praetor. Even later, Emperor Hadrian (117-136 AD) commissioned a final redaction of the text and prohibited any further changes. The edict had thus changed its nature from being an announcement by the praetor himself to being a legal rule binding on the praetor himself, which made known to all citizens under what circumstances they could bring a successful action in the Roman courts. This final text is called the edictum perpetuum (the eternal edict). Lenel reconstructed both the text of the edict and tried to establish the order in which the surviving fragments of legal writings had originally been presented before they were cut out and rearranged in the digest. The reconstruction of the edict is the subject of this prize-winning book 'Das edictum perpetuum' (Scientia Verlag, 2010, ISBN 03511000653). The results of his research on the writings of the Roman jurists are contained in these two volumes entitled 'Palingenesia juris civilis'. The subjects of the two books are linked, because many books by Roman jurists were commentaries on the edict or at least they followed the structure of the edict. By studying the structure of the scholarly writings of the jurists Lenel found out how the edict was structured and what provisions it contained. Lenel's work is extremely important for the history of Roman law.
