The author draws attention to the differences between the Prize Code and the Declaration of Paris. The author argues that the German Prize Code and the separate Prize Court Ordinance, which came into force on August 3, 1914, are not binding on the courts, the Declaration of London, or the decisions of prize courts of other jurisdictions. However, where treaties are involved, resort must be had to their provisions. The author concludes by positing that their importance is due to the general principles underlying the ordinances which they interpret and apply, and that in cases not covered by the express provisions of law, resort may be had to an interpretation of the general principles underlying the ordinances.
