The author argues that the legal concept of the Jewish community as autonomous was created by the rabbis specifically in reaction to the persecution of Jews during the Middle Ages. Until that time, Judaism had been largely defined by its religious practices, with little emphasis on Jewish law. However, as Jews were increasingly forced to live in separate communities and were denied access to the legal system of the majority population, the rabbis developed a comprehensive system of Jewish law that governed all aspects of Jewish life. This system of law was based on the Talmud, the traditional Jewish text, and was enforced by Jewish courts. The author argues that the development of Jewish law was a creative response to the challenges faced by Jews in the Middle Ages. It allowed Jews to maintain their religious identity and to live in relative autonomy within a hostile society. However, the author also argues that the concept of Jewish autonomy was ultimately a product of its time and place. As Jews gained emancipation in the 19th century, the need for a separate system of Jewish law diminished. Today, Jewish law continues to play an important role in the lives of many Jews, but it is no longer the exclusive source of Jewish identity or legal authority.
