Could the standard of review that the Supreme Court applies in the vast majority of constitutional settings itself be unconstitutional? The Georgetown Center for the Constitution, working together with the Institute for Justice’s Center for Judicial Engagement, hosted a symposium that brought together some of the nation’s most distinguished constitutional scholars, along with some of the nation’s most experienced rational-basis litigators, to consider whether the Supreme Court’s default standard for deciding constitutional cases might violate the Constitution. The symposium represented the first concerted academic effort to explore the constitutionality of modern rational-basis review. All essays contained in this book were originally published as articles in The Georgetown Journal of Law & Public Policy.
