Since its first edition, this work has provided the candidate attorney, the advocate serving pupillage and the senior student with an ex planation of how the principles of civil procedure are applied in practice.It sets out the steps followed in the various magistrates' courts proceedings and illustrates these by means of examples of pleadings and notices, including prescribed forms. It contains comprehensive indexes with cross references to case law; to the relevant sections of the Magistrates' Courts Act 32 of 1944; to the relevant Rules; to the prescribed forms; and to other examples. It refers to other standard texts on civil procedure. Since the publication of the previous edition, the Constitution of South Africa Act 108 of 1996 has come into force. This has necessitated a complete rewrite of the section relating to the raising of constitutional issues in the magistrates' courts. Sections of the book relating to section 65A and to rule 49 also required rewriting.
