Synopsis

Economic activity is more globally integrated than ever before, but so is the scope of corporate misconduct. As more and more people across the world are affected by such malfeasance, the differences in legal redress have become increasingly visible. This transparency has resulted in a growing convergence towards an American model of robust private enforcement of the law, including the class-action lawsuit. This handbook brings together scholars from nearly two dozen countries to describe and assess the class-action procedure (or its equivalent) in their respective countries and, where possible, to offer empirical data on these systems. At the same time, the work presents a variety of multidisciplinary perspectives on class actions, from economics to philosophy, making this handbook an essential resource to academics, lawyers, and policymakers alike.

À propos des auteurs

Brian T. Fitzpatrick is Professor of Law at Vanderbilt Law School. His research focuses on class action litigation and federal courts. In 2010, he published what is still the most comprehensive empirical study of class action settlements in American federal courts. He is also the author of the provocative book, The Conservative Case for Class Actions (2019). Professor Fitzpatrick joined Vanderbilt's law faculty in 2007 after serving as the John M. Olin Fellow at New York University School of Law. He has clerked for Judge Diarmuid O'Scannlain on the U.S. Court of Appeals for the Ninth Circuit and Justice Antonin Scalia on the U.S. Supreme Court. Professor Fitzpatrick practiced commercial and appellate litigation for several years at Sidley Austin in Washington, D.C., and served as Special Counsel for Supreme Court Nominations to U.S. Senator John Cornyn.

Randall Thomas holds the John S. Beasley II Chair in Law and Business, Vanderbilt Law School. He works on issues such as hedge fund shareholder activism, executive compensation, corporate voting, corporate litigation, shareholder voting, and mergers and acquisitions. He joined the Vanderbilt law faculty in 2000 to develop and direct the Law and Business Program, having served previously for 10 years on the law faculty of the University of Iowa.
