Since the establishment of the South African truthcommission and the international tribunal in Arusha, the continenthas been central in debates about how to deal with past injusticesand achieve political transition. This book examines a series ofcases where peaceful new beginnings have beendeclared after periods of violence and where transitional justiceinstitutions played a role in defining justice and the newsocio–political order.
Covering Uganda, Rwanda, South Africa, Kenya, Sierra Leone andMauritania, the book focuses on three issues that are key tounderstanding new beginnings : the problem of findinga foundation for that which explicitly breaks with the past; thediscrepancies between lofty promises and the chaotic realities oftransitional justice in action; and the dialectic between logics ofthe exception and the ordinary, employed to legitimize or resisttransitional justice mechanisms.
With contributions from an international array of leading scholars,from South Africa, Europe, USA and Canada, this timely publicationis invaluable in understanding the many complex issues associatedwith transitional justice in Africa.Gerhard Anders is lecturer at the Centre of AfricanStudies, University of Edinburgh. He has conducted research onthe implementation of the good governance agenda, internationalcriminal justice and transitional justice in Africa. He isco–editor of Corruption and the Secret of Law: A LegalAnthropological Perspective (2007) and authorof In the Shadow of Good Governance: An Ethnography ofCivil Service Reform in Africa (2010).
Olaf Zenker is Junior Professor at the Institute ofSocial and Cultural Anthropology, Freie Universität Berlin. Hehas done research on Irish language revivalism and ethnicity inNorthern Ireland and currently studies the moral modernity of thenew South African state in the context of its land restitutionprocess. He is the author of Irish/ness Is All Around Us:Language Revivalism and the Culture of Ethnic Identity in NorthernIreland (2013) and co–editor of The State and theParadox of Customary Law in Africa (2015).
