Notable English Trials has called forth criticism from some of the Editor s Scottish friends. It is surely an overstrained patriotism which grudges England the record of a criminal trial. It is admitted that the impeached peer, the evidence which overwhelmed him, and the Rising in which he was involved, were all unassailably Scottish; but the trial took place in Westminster Hall, and the procedure adopted was purely English in origin. The Lord Chancellor presided, the Managers who conducted the prosecution were led by the English law officers of the Crown (one of whom happened to be a Scotsman). The prisoner was impeached by the Commons and tried by the Lords a method of judging which has no historic parallel in Scotland, as Lords and Commons in Scotland before the Union were members of one House. It has not been considered desirable to prefix an elaborated record of Lord Lovat slife. The Editor has endeavoured to give a condensed account of the doings of the accused peer, long enough to give fair estimate of his strangely assorted characteristics, but short enough to leave the reader with the desire to peruse the full biographies by Dr. Hill Burton and Mr. W.
