Unlike some other reproductions of classic texts (1) We have not used OCR(Optical Character Recognition), as this leads to bad quality books with introduced typos. (2) In books where there are images such as portraits, maps, sketches etc We have endeavoured to keep the quality of these images, so they represent accurately the original artefact. Although occasionally there may be certain imperfections with these old texts, we feel they deserve to be made available for future generations to enjoy.

On the 5th March, 1872, in moving that the Indian Evidence A ct shovdd be taken into consideration by the Legislative Council, I said many topics closely connected with the subject of Evidence are incapable of being satisfactorily dealt with by ex press law. It would be easy to dilate upon the theory on which the whole subject rests, and the manner in which an A ct of this kind should be used in practice. I think, however, that it would not be proper to do so on the present occasion. I have therefore put into writing what I have to say on these subjects, and I propose to publish what I have written, by way of a commentary upon, or intro duction to, the A ct itself I hope that this may be some use to Civil Servants who are preparing in England for their Indian career, and to the law students in Indian universities. The subject is one which reaches far beyond law. The law of evidence is nothing unless it is founded upon a rational conception of the manner in which truth as to all matters of fact whatever ought to be in vestigated. This, written for the most part before these remarks were made, but corrected and completed since my return to England, is the Introduction referred to.
