Some words of introduction seem desirable in order to explain what this book aims at, and what it does not. The subject is theL and Laws of England, not those of Scotland or of I reland, which, for diflferent reasons, were beyond my plan. Scotland has a distinct legal system of her own with a distinct history; the study of it, a highly interesting one so far as with my slight knowledge of it I can judge, would be a separate undertaking. I rish land law, on the other hand, is nothing but imported English law with certain modifications. The only material modifications are those lately made in the relations of landlord and tenant, and they are too much involved with political controversies, and with still unsettled questions peculiar to I reland, to be profitably treated in connection withE nglish institutions. Dealing, then, withE ngland alone, I have endeavoured to make the principles and the leading features of our law of real property intelligible to a reader who is without legal training, but is willing to take some little pains to understand.

This book was originally published prior to 1923, and represents a reproduction of an important historical work, maintaining the same format as the original work. While some publishers have opted to apply OCR (optical character recognition) technology to the process, we believe this leads to sub-optimal results (frequent typographical errors, strange characters and confusing formatting) and does not adequately preserve the historical character of the original artifact. We believe this work is culturally important in its original archival form. While we strive to adequately clean and digitally enhance the original work, there are occasionally instances where imperfections such as blurred or missing pages, poor pictures or errant marks may have been introduced due to either the quality of the original work or the scanning process itself. Despite these occasional imperfections, we have brought it back into print as part of our ongoing global book preservation commitment, providing customers with access to the best possible historical reprints. We appreciate your understanding of these occasional imperfections, and sincerely hope you enjoy seeing the book in a format as close as possible to that intended by the original publisher.

Paperback. Etat : New. Print on Demand. This book delves into the fascinating history of land ownership in England, taking readers on a journey through the layers of tradition, law, and societal shifts that have shaped the current system. The author expertly guides us from the ancient customs of Germanic tribes to the complexities of feudalism and the rise of private property. We encounter diverse forms of land ownership, from communal holdings and heir lands to the emergence of book land with its written grants and greater individual control. The book explores the intricate relationship between owners and occupiers, shedding light on the historical context of tenancies, leases, and the evolving rights of commoners. As we navigate the transformation of English land laws, we gain a deeper understanding of the enduring influences of feudalism, the role of the Church in shaping land ownership, and the gradual shift towards a more commercial view of land as a commodity. The author's insights illuminate the often-overlooked complexities of land tenure, challenging common assumptions and revealing the historical forces that continue to impact our understanding of ownership and rights to this day.
