The purpose in selecting these cases has been to furnish as complete a study as possible of the Law of Water Rights. Because of lack of space where the California and Colorado doctrines conflict upon any principle, no attempt has been madie to use cases establishing the Colorado doctrine. In arranging the cases it has been the aim to place them in such order as to follow the growth and development of one principle from another. Such an arrangement should aid the student to more readily understand the underlying reasons and sound logic upon which this branch of our jurisprudence has been built. The chief advantage of the study of law by cases is that the studlent is trained by this method better than by any other to extract from the cases the principles of law upon which the decision is based. Therefore, the statements of reporters, and points, authorities and arguments of counsel, have been left out. For the sake of brevity and a clearer understanding of the law, parts of decisions dealing with other questions than those having to do with Water Rights have also been omitted. As the cases selected are intended to be used by those desiring a knowledge of the Law of Water Rights as it exists in the Pacific and some of the semi-arid states of the west, the latest decisions of the courts of these states are presented rather than English, eastern or older western cases.
