To enter upon a new field of legal literature is a step which cannot be taken without considerable misgivings; and I think timidity on the part of an author would be excusable even were there no beacons in existence to warn him of the dangers and difficulties which must attend his enterprise. At the time when I conceived the design which I have now executed, I was impressed with the laborious and difficult nature of the work, and this impression certainlj did not diminish as the work progressed, and my leisure time became more limited. The law with which I have had to deal is almost entirely judge-made. It is the result of judicial labour, extending from the time of Lord Mansfield to the date of the present publication, applied to a singularly crude and ill-framed instrument a policy of marine insurance. Every sentence of the old Lloyd spolicy has received its interpretation by a variety of minds, dealing with peculiar circumstances; and, as time has advanced and commercial transactions have become more complicated, it has necessarily been more difficult to secure uniformity of decision.
