Paperback. Etat : New. Print on Demand. This book examines several recent court cases that have jeopardized worker and retiree pension protections under the Employee Retirement Income Security Act (ERISA). The author argues that these court decisions have weakened the security of pensions and health benefits for millions of workers. In Mertens v. Hewitt Associates, the US Supreme Court eliminated most liability on the part of non-fiduciaries who knowingly participate in fiduciary breaches and made it uncertain which remedies are available to address violations of ERISA. The author argues that these decisions have made it difficult for the Department of Labor to protect workers and retirees and have left many former participants and beneficiaries without a meaningful remedy for illegal denials of benefits. The book concludes by urging Congress to address these issues and restore the protections that were intended by ERISA.
