Challenge to compulsory education laws and their reach into families and schools This book examines how state power to mandate school attendance has grown in Ohio and across the United States, and what that means for parents, churches, and the public school system.
The discussion places the late 19th and early 20th century debates in a practical frame, showing how laws started with truancy rules and expanded toward full public schooling. It explores constitutional questions, parental rights, and the role of the state in shaping education, with careful attention to how different groups react to these changes.

On the 28th day of A pril, 1890, a person styling himself a truant officer called on me and demanded a list of the pupils of St. Francis de Sales School, giving their names, residences, ages, etc. I refused. I was indicted for a violation of the Compulsory Education Law of the State of Ohio, arrested, imprisoned, and criminally prosecuted in the Court of Common Pleas. The case was carried to the Circuit Court, and thence to the Supreme Court of the State, and a decision rendered on the 10th day of May, a.d. 1892. A writer in the Edvxiationqil Beview for September, 1892, says: This Toledo case was argued and decided on broad constitutional grounds, and perhaps no decision more important to the future of all compulsory education legislation in this country has ever been rendered by an American court. E d. Bev. Henry Holt Co., New York, Sept. 1892.) As this matter of compulsory education affects every man, woman, and child in the country, a report of the most important decision with regard to it ever rendered by any American court must be a matter of very great interest to the American people. That report is now presented to the public. Before proceeding to the consideration of the case itself, it will be well to look a little at the legislation on the subject out of which this case arose.

Paperback. Etat : New. Print on Demand. This book is a report of a trial held in Ohio during the late 19th century. The trial stems from the introduction of a new compulsory education law that mandated all children between the ages of eight and fourteen to attend some form of school for a minimum of twenty weeks per year. The author focuses on the case of Patrick F. Quigley, a priest of the area who refused to provide the names and other information of children in his parish to the authorities, as was required by the new law. The author provides a detailed account of the legal arguments presented during the trial, as well as the social and political context surrounding them. The author also explores the broader implications of the case, including the tension between religious freedom and the state's interest in education. This book offers a valuable glimpse into the history of education law in the United States and the complex issues surrounding it.
