The ordinance, known as the Jackson Franchise, was granted by the City of Colorado Springs in 1898 for 25 years to one George W. Jackson, and by him assigned to the Pikes Peak Hydro-Electric Company. The franchise gave the grantee the use of the City's water supply for the purposes of power generation and also stipulated that the grantee would, in return, furnish to the grantor for electric lighting, arc lights of standard candle power at the rate of $60 per annum. The controversy arose over the interpretation of the phrase "An arc light of standard candle power." The city argued that the lights furnished by the company were not of the required candle power, while the company maintained that they were. The case was eventually submitted to arbitration. The arbitration board ruled in favor of the city, finding that the company had not provided lights of the required candle power and awarding the city damages. The book provides a detailed account of the controversy, including the testimony of witnesses and the arguments of attorneys. It also discusses the broader historical context of the controversy, including the development of electric lighting and the role of municipalities in regulating public utilities.
