Paperback. Etat : New. Print on Demand. This book details the nature and properties of derivative instruments known as appointments. These instruments take their effect from the deed out of which the power of appointment arises, and as such, it is necessary for the limitations attempted to be executed by the appointment to be such as would be valid had they been inserted in the deed creating the power to appoint. Thus, limitations in marriage settlements to unborn children of unborn children are ineffective, as is a power to appoint to grandchildren where the children themselves are yet unborn at the time of creating the power. As the execution of a power of appointment is considered as part of the deed out of which the power arises, it is not necessary that such deed should be expressly recited, or otherwise referred to. However, this distinction has been taken between the cases where the power is to appoint to such persons for such estates, and subject to such powers as the appointor and his wife shall jointly appoint, under which limitation the use is immediately executed in the husband and wife for life, with remainder to the husband alone in fee, but the moment that they appoint the estate under this power in any other manner, the use hitherto executed in the husband in fee, is shifted by the operation of the Statute of Uses from him to the appointee, in whom it will vest precisely in the same manner as it would have vested had a similar limitation been made to him in the deed creating the power to appoint. The use vesting in him by the appointment, and the possession by the same, which union of the use and possession constitute what is termed the legal estate. The author thoroughly explores this concept and others related to the nature of appointment instruments and their impact.
