This book is a treatise on the constitutional questions arising from the acquisition and government of the Philippine Islands, considered in the light of the principles underlying the American Constitutional system. The author, a prominent lawyer and jurist, was a contemporary observer of Senator Platt's speech delivered in the Senate in 1898 that ignited this line of inquiry. He posits that this speech attempted to establish an interpretation of the powers of the federal government under the Constitution that was in conflict with all prior authority on the subject. The author then refutes the ideas put forth in the speech by referencing the well-established theory of constitutional law accepted by all legal scholars since the inception of the Republic. The author proceeds to lay down the correct interpretation of the powers of the U.S. federal government in a manner that acknowledges the sovereignty of the People who form the nation and the restricted sovereignty of their Government as meted out by the Constitution. It becomes clear that the government possesses no inherent sovereign right that exists independently of the clauses of the Constitution and that the speech under consideration had it entirely backwards.
