History of the Constitution of England has hitherto only been written with regard to theM iddle A ges, and separate centuries since the Reformation. In venturing to draw a picture of the thousand years Constitutional History of such a nation, I must necessarily begin with an apology in order to explain the shortcomings and inequalities of my work, and in some measure to justify them in the eyes of the benevolent reader. My writings upon theE nglish Constitution did not originate in a uniform scientific plan; my Roman law professorship offered few points of connection with this subject, although I am much indebted, in these writings, to the works upon the history of Law of my revered teacher, vonS avigny. It was rather the efforts for reform in the German legal procedure which gave rise to these essays. Brought up in the laborious and strict school of Prussian Judges, at a time when the whole task of formulating the matter in litigation was entailed upon the judge who personally directed the pleadings of the parties, and having acquired a personal knowledge of the political and social state of Germany, England, andF rance, I had become sufficiently intimate with the advantages of our nation of officials, as well as with the weak points of our system, both in legal procedure and administration.
