Synopsis

There has been a trend in recent years in schools enacting a strict dress code and uniform policy. Schools have argued that these policies will improve conditions in such areas as academics and discipline. In this paper, I discuss various issues relating to dress code and present many of the arguments and court cases relevant to this problem. I begin with an introduction of various dress code policies and their impact on students. I then present arguments for and against a dress code policy by citing the infamous Tinker v. Des Moines Independent School District case (1969). This case began a trend that saw students fighting dress code policies. Almost every case brought to the courts by students not wanting to adhere to a dress code policy is based upon the same reason, that is, violation of their First and 14th Amendment rights. I describe in detail cases that have followed since the Tinker v. Des Moines case. I am not taking sides on this matter; rather, I am leaving the decision about the appropriateness of a dress code and uniform policy to the reader.
