The legal framework that underpins the federal procedure system emanates from four sources of binding authority: (1) the Constitution of the United States; (2) the Federal Rules of Civil Procedure (FRCP) and Federal Rules of Appellate Procedure (FRAP); (3) the Judiciary Code (enacted by Congress and codified by Title 28 of the United States Codes); and (4) federal case law.
