Synopsis

This is a practical guidebook for women injured by transvaginal pelvic mesh implants, and for attorneys desiring to represent them. The author has observed 6 pelvic mesh trials in the Philadelphia Court of Common Pleas and has worked briefly at a Philadelphia law firm handling these types of cases. The author has not found any other guidebook of practical information or continuing legal education courses related to pelvic mesh litigation. There should be more - books and courses - to teach what is needful to become a knowledgeable and skilled pelvic mesh litigator. For lawyers wanting to learn more about mass tort programs, and the pelvic mesh mass tort program in particular, hopefully this will be that guide. The author is a graduate of Georgetown University Law Center in Washington, D.C. She has held many interesting positions exposing her to trial practice and different facets of the litigation process. She is compassionate and has practical experience she desires to share with women suffering from urinary incontinence. This guidebook contains a section where the author shares suggestions she has learned from her own experience which may help alleviate incontinence symptoms, things which do not require surgery. Another section details the conditions women have - stress urinary incontinence (SUI) and pelvic organ prolapse (POP) - which led them to getting a mesh implant in the first place. The author desires to help women with their pelvic mesh cases, and to assist lawyers who are handling or want to handle these types of cases. This guidebook contains a section of helpful tips for handling pelvic mesh cases which the author has learned from observing 6 pelvic mesh trials and working on such cases herself. The author adds her own legal impressions and interpretations to the information she cites from relevant internet articles. She desires to provide both information and citations to online articles that will aid the readers to do their own further reading on the information contained in this guidebook. On March 10, 2020 the author went to the hearing herself in the Pennsylvania Supreme Court, and heard oral argument on the mesh manufacturers’ appeal of the jury's verdict against them and their claim that the Philadelphia Court did not properly exercise personal jurisdiction over them in accordance with due process and Pennsylvania’s Long Arm Statute. She reported a summary of what she heard in that oral argument session, and also gives the URL to an online article also reporting about this same case, to direct the reader to additional information she learned concerning the Supreme Court’s hearing on this important issue. The author wants to give women information so they can assist their lawyers and have a better chance of winning their cases, and provides links to additional information she found so injured women can do their own research, to weigh their options and have their eyes opened to the severe, frequent and permanent injuries which they are opening themselves up to if they choose to have a mesh implant to treat their stress urinary incontinence and pelvic organ prolapse. This is an important guidebook filling a niche that no one else has stepped up to fill. Deborah Silver hopes this book will fill that void and provide helpful information she has learned in her quest to help women injured by pelvic mesh products.
