Besides the Marshall Islands Rules of Evidence, the "added value" to this book is a 16-page section on making and responding to common objections (including a discussion of the 15 most common objections and a list of 60 common trial objections) and over 60 pages on evidentiary foundations and impeachment - including 25 examples of foundations for introducing physical, electronic, hearsay, and social media evidence, emails, text messages, internet sites, and a discussion on differing standards for authenticating digital evidence, and sample impeachment foundations.
The author is a former Detroit criminal trial lawyer, a full-time law professor for over 50 years - over 45 years at the William S. Richardson School of Law at the University of Hawaii and 5 years at Wayne State Law School in Detroit. His students have represented real clients in real cases every year he has been teaching. He has taught evidence since 1981 and has been the Director, and now Co-Director, of the Law School's Clinical Program since 1978. He has been a member of the Hawaii Supreme Court's Standing Committee on the Rules of Evidence since 1993. This handbook, and other similar handbooks, were inspired by his 2019 workshop for Pacific Island Judges from American Samoa, Marshall Islands, Federated States of Micronesia, Chuuk, Kosrae, Pohnpei, and Yap. He has published evidence handbooks similar to this one for all 50 states as well as 15 other jurisdictions from American Samoa to the U.S. Virgin Islands.
He has taught, trained, and consulted in the areas of evidence, mediation, strategic planning, and procedure, in the Asia-Pacific area in American Samoa, Chuuk, Federated States of Micronesia, Kosrae, Marshall Islands, Northern Mariana Islands, Palau, Pohnpei, and Yap, since 1981, including leading a 5-day evidence workshop for Pacific Island lay judges (Honolulu Dec. 2019); 1-day workshop on mediation for state, federal, and national judges from American Samoa, Commonwealth of the Northern Mariana Islands, Federated States of Micronesia, Guam, and Palau (Pago Pago, American Samoa April 2016); 5-day evidence workshop for Pacific Island lay judges (Honolulu July. 2014); trainer for 7-day mediation workshops for 30-50 Judges from the Kingdom of Thailand (Honolulu, 2008, 2010, 2012, 2014); facilitated the strategic planning process and drafted a strategic plan for the Judiciary of the Federated States of Micronesia (Pohnpei, Federated States of Micronesia, July 2012); consultant and facilitator to create a strategic plan for the Judiciary of the Republic of the Marshall Islands (Majuro, Republic of the Marshall Islands, 2007); evidence workshop for the Pacific Judicial Council (Saipan, Commonwealth of the Northern Mariana Islands, Dec. 1996); taught a.one-week "Mediation Training for Land Disputes & Court Cases," for the Department of Land and the Supreme Court of Pohnpei (Pohnpei, Federated States of Micronesia, May 1994); 6 days of "Advanced Mediation Training," "Introduction to Mediation," and "Advocacy Skills Training" workshops for the Kosrae State Court ( Kosrae, Federated States of Micronesia, 1992); 4-day "Mediation Training for Land Dispute Cases," r for land commissioners and other state employees for the Kosrae State Court (Kosrae, Federated States of Micronesia, April 1991); 5-day seminar on Judicial Administration and Legal Skills for the Republic of Palau (Koror, Palau, Jan. 1985); lead a 4-week Judicial Administration and Alternative Dispute Resolution Project, as consultant to the National Judiciary of the Federated States of Micronesia (on‑site in Yap, Palau, Truk, and Ponape, July‑Aug. 1984); served as a consultant to the Minister for Justice for Papua New Guinea, on site in Port Moresby and the Highland Provinces, on the Village Court Project (Papua New Guinea, Jan. 1981).
