Présentation de l'éditeur

Civil Litigation is a thorough, up to date and practical introduction to the Civil Procedure Rules and the principles and tactics used in pursuing a civil case. The civil process has been divided into five stages, starting with pre-action considerations, moving on to examine the issue and service of proceedings, before considering interim matters, trial and enforcement. The aim of the book is to equip readers with the knowledge necessary to enable them successfully to navigate their way through these stages. The text has a user-friendly structure and includes checklists and specimen documents which build up into a case study forming a useful overview of the civil litigation process. The appendices incorporate helpful templates, flow diagrams, case study documents and copies of the more common court forms used in civil litigation. This edition incorporates changes dealing with professional conduct issues; the overriding objective; drafting a claim form; the creation of the Business and Property Courts of England and Wales; sanctions; costs management; costs capping; security for costs and Part 36. New cases include Weir v Hildson (2017) (professional conduct); British Gas Trading Ltd v Oak Cash and Carry Ltd (2016) (relief from sanctions); Intellimedia Systems Ltd v Richards (2017) and Agents' Mutual Ltd v Halman (2016) (costs budgets); Gentry v Miller (2016) (setting aside default judgment); Chapman v Tameside Hospital NHS Foundation Trust (2016) (disclosure); Sarpd Oil International Ltd v Addax Energy SA (2016) (security for costs); EXP v Barker (2017) (experts); and Thakkar v Patel (2017) (Part 36).
