Synopsis

The main role of the government in the economic life of a nation should be to assure effective competition. Strong competition is needed for the health and vigor of the industry. This is the theory of Adam Smith and many other economists. Antitrust law of the USA prohibits agreements that interferes with competition. This law exists in many countries. The violation of the constitution is a major source of class action litigation. The criminal courts award treble damages for the violations. Some countries define it as a felony. Strong competition, in turn, depends on the strong compliance with Article 14 of the Constitution of India. This article is more powerful than the antitrust law of the USA. Monopoly achieved solely by merit is perfectly legal. But a government should not favor any company. When it favors one company without any valid reason, it hurts and kills all the rest. The competition between a public sector company and a private company will never be an equal one. Any government – working in good faith- will split the Public Sector Undertakings (PSUs) and apportion them among the States to promote competition among them. Further, the government will abolish the policy of bulk buying. It will give contract works – as for as possible- in pieces; preference being given to the people of respective localities. The profit from the minerals is necessary for the physical and mental wellbeing of the people. Therefore, the State Governments will exploit them directly. Every State government will have a separate foreign exchange account. I represented these points long before coming across Adam Smith and others. In contrast, the Government of India demands that all natural resources, all PSUs, all money in the banks, Provident Fund and Pension Fund and the entire foreign exchange should be handed over to about ten men. All contract works also must be given in one go. Everything must be merged and consolidated. The ten men would bring truck load of money from their secret bank accounts to make India a prosperous nation. Some people call it New Economic Theory of Dr. Manmohan Singh. The above theory is a flawed one because the Constitution of India prohibits agreements that interfere with equality and competition. The Constitution of India is not for the present generation only. It is for all future generations. The President of India should respect the Constitution of India because it is the source of his/her authority. The role of the President is give effect to the Constitution. The President should not interpret the Constitution in a way that would make or require the Government of India, Prime Minister of India, Election Commission of India or the Supreme Court of India to commit illegal acts. Further, the President of India is the guardian of the rights of people. Only if he/she discharges his fiduciary responsibility, other organs of the nation would perform their fiduciary responsibilities. When the Supreme Court of India subverts the Constitution, the President of India must play a fundamental role in ensuring rule of law. This is his inescapable responsibility. In fact, the President of India is the sole authority to remedy the violations of the Constitution of India by the Supreme Court of India. The pleasure of the President of India is the paramount factor that would determine the legitimacy of any constitutional entity in India. Ultimately the rule of reason alone would prevail’. This is my conclusion.
