Il est bien établi que la croissance économique dépend en grande partie du progrès technologique et que les gains de productivité sont essentiels à l'augmentation des revenus et du niveau de vie. Alors que les industries de haute technologie ont considérablement augmenté leur importance dans la performance économique mondiale dans les années 1980 et 1990, et que la politique économique s'est de plus en plus concentrée sur l'innovation, les lois sur les fusions sont devenues un élément crucial de l'application des lois antitrust des deux côtés de l'Atlantique. Ces dernières années, de nombreuses fusions et acquisitions de contrôle ont eu lieu dans des industries axées sur l'innovation. Il est donc important de poser une question fondamentale : comment la pratique décisionnelle des autorités de concurrence reflète-t-elle l'importance du progrès technologique ?
