Synopsis

The transfer of FDI competence to the EU with the Treaty of Lisbon opened the way for a more coherent EU international investment policy. Nevertheless, questions and challenges that need to be successfully addressed in order to achieve the dynamic EU investment policy desired by the EU treaty-makers are still unresolved. This volume focuses on topical and highly-debated issues including the role of the Member States during the negotiation and conclusion of future EU investment agreements and gives specific attention to the ongoing negotiations with Canada as well as the upcoming ones with China. Furthermore, it discusses the inclusion of investor-state dispute settlement provisions in these agreements as well as the status of national investment insurance systems in the wake of the Treaty of Lisbon.

The transfer of Foreign Direct Investment competence to the EU within the Treaty of Lisbon opened the way for a more coherent EU international investment policy. Two and a half years on, an EU and Investment Agreements conference was convened to assess crucial issues that remain unresolved. This volume, which comprises the papers presented at that conference, focuses on topical and highly-debated issues such as the role of the Member States in the negotiation and conclusion of future EU investment agreements, the inclusion of investor-state dispute settlement provisions in these agreements, and the status of national investment insurance systems in the wake of the Treaty of Lisbon. These are the key topics which pose as yet unresolved questions and challenges that need to be successfully tackled in order for the EU to achieve its goal of a dynamic international investment policy.

Biographie de l'auteur

Marc Bungenberg is the Chair of Public Law, European Law, Public International Law and International Economic Law at the University of Siegen and an Academic Advisor to the International Investment Law Centre Cologne. August Reinisch is Professor of International and European Law and head of the Section for International Law and International Relations at the University of Vienna. Christian Tietje is Professor of International and European Law and International Economic Law at the Martiin-Luther-Universitat Halle Wittemberg.
