Une discipline des fonctionnaires au sein d'une organisation nécessite quatre caractéristiques : un certain nombre d'infractions disciplinaires, des peines proportionnées clairement liées aux infractions disciplinaires, la surveillance et les appels des décisions disciplinaires et l'indépendance vis-à-vis des politiciens. Cet article examine la législation du secteur public en Ukraine, en Pologne, en République tchèque, en Bulgarie, en République hellénique, en République de Lituanie pour montrer les particularités de la réglementation juridique de chacun de ces critères. Nous soutenons - une affirmation selon laquelle la création de pouvoirs arbitraires pour punir ou licencier le personnel est injuste si la législation n'informe pas pleinement le personnel de ce que constitue un manquement à la discipline, si elle ne garantit pas des peines proportionnées aux infractions, et/ou permet l'utilisation du processus disciplinaire comme outil pour contraindre le personnel à effectuer dans un cadre politisé ou non de manière éthique. Dans l'article, les quatre critères sont présentés par analyse comparative avec certains membres de l'UE (Pologne, Bulgarie, République tchèque, République hellénique, République de Lituanie).
