Synopsis
À la suite de la publication du Code Général des Processus Organiques, plusieurs types de procédures applicables au sein de la loi procédurale ont été créés, parmi lesquels on retrouve la nouvelle procédure d'ordre de paiement. Figure qu'au cours des cinq dernières années a été largement développé en Équateur, pour être un mécanisme qui facilite le recouvrement d'une dette acquise par le biais d'un titre exécutif, ce mécanisme aide à résoudre un conflit en peu de temps. Le but de cette recherche est de connaître le développement et l'impact que la procédure d'ordre de paiement a eu dans notre système juridique. À ses débuts, la procédure d'ordonnance de paiement découle de la loi procédurale romaine et germanique, s'étendant à plusieurs pays européens tels que l'Italie, la France, l'Espagne, entre autres pays d'Amérique latine, favorisant son utilisation. Cette nouvelle procédure adoptée par notre législation dans le Code Général des Processus Organiques est considérée comme un outil efficace et efficace utilisé par plusieurs professionnels du droit.
