The author’s main objective was to assess the way of determining and distributing properties commonly owned by unlawful married partners in case their cohabitation ends. Additionally, when some difficulties are discovered, the author also aimed to suggest effective mechanisms to be used in determination of common assets to be distributed between unlawful married partners in any case of termination of their cohabitation for the purpose of protecting their rights on commonly owned properties. To achieve the said objectives, the author’s work was divided into three chapters. The first chapter discussed about the concepts of marriage and unlawful marriage; the second chapter discussed the challenges related to determination and distribution of common assets in case of termination of unlawful marriage, it is very important to mention that analysis in this chapter were done basing on article 39 of the law no 59/2008 of 10/09/2008 on prevention and punishment of gender based violence and its interpretations made by different courts in Rwanda as quoted in this book. Finally the last chapter proposed solutions to the challenges that were discovered in the second chapter.
