This contract, which dates back to antiquity, has only received the interest it deserves in recent years, when doctrine and jurisprudence have given it prominence. Today, however, the contract is being called into question by a critical thesis as to its usefulness and even existence. However, it does exist, and its usefulness is not in doubt.
