Synopsis

Parallel State and Arbitral Procedures in international Arbitration prepared by the ICC Institue of World Business Law, addresses one of the most sensitive issues in arbitral procedures, when commercial arbitrations conflict with other commercial arbitrations, or investment arbitrations, or with court proceedings, or when the same dispute gives rise to distinct arbitration proccedings, which then risk leading to contradictory awards. We repeatedly see a form of Arbitral Forum Shopping which may generate public policy problems. Rather than investigating the theoretical solution of establishing a world wide appeal system for arbitration awards, this Dossier aims to analyses the possible existence of a consistent case law on the matter. With this Dossier, the ICC institue fulfils its dual mission: training and acting as a think-tank for ICC, particularly in the arbitration field. Its Chairman since 1999 is Serge Lazareff, a member of the Paris Bar.

He is President of the Spanish Court of Arbitration, President of the Global Center for Settlement of Business Disputes Research, New York, and a Council Member of the ICC Institute. JULIAN D.M. LEW, QC is a Barrister at 20 Essex St. Chambers, London, specializing in international arbitration. He is also Visiting Professor and Head of the School of International Arbitration, Centre for Commercial Law Studies, Queen Mary, University of London and a Council Member of the ICC Institute.
