Synopsis

In International law, the rights of Indigenous Peoples are best enshrined in two international instruments - the United Nations Declarations on the Rights of Indigenous Peoples (UNDRIP) and the International Labour Organization's Convention No 169 on Indigenous and Tribal Peoples (ILO C169). Set against the benchmark of these two international instruments, Red & Raw assesses how Malaysia's legal framework and policies fare against them. In pitting the Federal Constitution and the various national and state laws against the UNDRIP and ILO C169, it is clear why the Orang Asal or Indigenous Peoples are among the most marginalized groups of Malaysians today. The study extends several legislative and policy reforms and recommendations in order to get the Orang Asal out of their current situation and plight. Towards this end, Red & Raw is an important resource for advocating for the rights of the Indigenous Peoples of Malaysia. This is especially so in the pursuit of the establishment of a National Commission on Indigenous Peoples.
