Synopsis

When a mining company arrives, it comes with lawyers, engineers, financial analysts, and a plan years in the making. The community it negotiates with usually has none of these things.

That asymmetry decides outcomes before the first meeting ever takes place. When the Mine Arrives exists to close the gap.

Written by a mediator who has worked on both sides of the table, including years inside a mining company designing its community engagement strategy, this is the practical, honest guide that speaks directly to the communities most affected by mining, in language they can actually use.

Across eighteen chapters and five appendices, it walks your community through every stage of the journey:

  • Understand the landscape: how mining projects really work, where your leverage is highest, and what the company wants (and what it fears).
  • Get organized: decide who speaks for the community, build a team of allies and advisors, and turn information into power.
  • Negotiate well: prepare properly, recognize and counter common company tactics, and secure community benefit agreements with protections that actually hold.
  • Protect what matters: win real environmental and health safeguards, and the monitoring needed to enforce them.
  • Hold them to it: enforce commitments, resolve disputes, and adapt agreements over the decades a mine operates.
  • Handle the hardest situations: when the government is not on your side, indigenous rights and consent, the gender dimensions of mining impacts, artisanal and small-scale mining, and when the answer is no.

The appendices add a due diligence checklist, ready-to-use template letters, a plain-language glossary, and The Twenty Things Every Affected Community Should Know.

Who this book is for: community leaders and members; the farmer watching surveyors peg out land above the village; and the advisors, organizers, lawyers, and NGOs who support them.

This is the community-facing volume of the Social Accord Architecture reference library, the discipline Thomas Gaultier developed to treat company-community engagement as carefully engineered infrastructure: as rigorously designed and durably maintained as the road, the pit, or the processing plant.

About the author: Thomas Gaultier is a mediator and lawyer who has mediated thousands of community claims across Sub-Saharan Africa and Europe, served as a community and social performance officer on a lithium project in Portugal, and trained some of the world's largest mining groups in conflict prevention and resolution. He is admitted to the New York Bar, teaches negotiation and mediation at the Universidade Catolica Portuguesa, and is the author of Mediating Extractive Conflicts and The Human Shock Absorber.

We do not stumble into agreements. We design them.
