Synopsis

Despite the fact that “Natural Born Citizen” is a constitutional requirement for the presidency of the United States, no one has legally defined the term. The debate about citizenship center over jus sanguinis or citizenship by right of blood and jus solis or citizenship acquired by the place of birth. These are mutually exclusive ideas. The debate hinges around the meaning of the phrase “…subject to the jurisdiction thereof…” from the Fourteenth Amendment. In this work, I will show the only legal path to citizenship in the United States is either jus sanguinis or naturalization, and a natural born citizen is a person whose parents are citizens at birth.
