Free Parliaments; Or a Vindication of the Fundamental Right of the Commons of England in Parliament Assembled, To be Sole Judges of All Those Privileges of the Electors, And of the Elected, Which are Absolutely Necessary to Preserve Free Parliaments, And a Free People. Being a Justification of the Proceedings of the Honourable House of Commons, In the Case of Ashby Against White. Printed in the Year 1704. Reprinted January, 1840. With an Introductory Preface. London: G.F. Cooper, Law Bookseller, 1840. 38 pp. Octavo (8-3/4" x 5-1/2"; 22.5 x 14 cm). Disbound pamphlet in self-wrappers, many signatures unopened. Ink presentation inscription "Lord John Russell with the Publishers Compliments" to head of front wrapper. $650. * Third and final edition. Also known as the Aylesbury Election Case, Ashby v. White is a fundamental case in English constitutional and tort law. Ashby was prevented from casting a vote in an Aylesbury election by White, a constable who claimed Ashby was not an established resident of that town. The case was decided in Parliament in Ashby's favor and it established the following rule: the actions of one party may not hinder the rights of another, and an injured party must be able to seek damages if those rights are infringed regardless of whether they incurred financial losses. It also had important ramifications for the jurisdiction of the House of Commons over common law. Generally attributed to Mackworth, some sources say the actual author of our pamphlet was Robert Harley, 1st Earl of Oxford. This copy is inscribed to John Russell, 1st Earl Russell [1792-1878], a liberal politician and advocate of modest law reforms who went on to serve as Prime Minister from 1846-1852 and 1865-1866. The third edition is rare. OCLC locates 2 copies (National Library of Australia, Cardiff University). None are added by Library Hub.…
