Hewart, who was Lord Chief Justice of England at the time, saw this "new despotism" as a move to give unfettered power to the executive branch and civil service at the expense of Parliament and the courts. Hewart criticized the practice of Parliament passing broad legislation and then giving executive departments wide authority to create detailed rules and regulations. He argued that this subordinated Parliament and amounted to a transfer of legislative power to unelected officials. According to Hewart, executive departments were increasingly given "quasi-judicial" powers, allowing civil servants to make decisions that were previously the domain of the courts. In this system, anonymous officials could render a decision without being required to give a reason. The "new" versus the "old" despotism: Hewart contrasts the methods of the new bureaucracy with the old, tyrannical kind. He argues that while the old despotism directly challenged Parliament, the new despotism "gives Parliament an anesthetic" by gradually usurping its power through procedural means. The book created a "constitutional and political storm" and, in response, the British government appointed the Donoughmore Committee to review the powers of ministers. While the committee's final report in 1932 was less alarmed than Hewart, his work led to a wider discussion among legal and political scholars. The New Despotism remains an influential work in the field of administrative law. It is also famously known as a favorite of former British Prime Minister Margaret Thatcher. The previous owner of this copy, Joseph M. Gleason [1869-1942], was a Catholic priest, historian and collector.…
