Period-style quarter calf over black cloth, raised bands, gilt lettering piece and blind ornaments to spine. Renewed endpapers. Light browning to text, minor edgewear and light soiling to endleaves. Signature to front endleaf " L. Poulson Dobson/ 1858". Small early owner initials "JGC", to head of title page. A handsome copy. $950. * The final major legal treatise written by Henry Home, Lord Kames, a preeminent Scottish jurist and a central intellectual force of the Scottish Enlightenment. Rather than operating as a passive restatement of active Scottish legislation, the text is structured as a philosophical critique of legal methodology, expressly designed to demonstrate forms of legal reasoning free from the shackles of absolute authority. Kames utilized this work to argue for what the common and statute law ought to be, applying the empirical and rationalist principles of his era to systemic jurisprudence. His innovative legal and social theories deeply influenced his contemporaries, including David Hume, James Boswell, and Adam Smith.
