Description :

In Colonial and early American history, debtors prisons were part of America. They were jails used to punish the financially misfortunate. In 1776, most of the original colonies passed their own state constitutions to coincide with the Declaration of Independence. Like the federal government, the states largely neglected to provide constitutional protections to debtors or were hostile to them. Every state except Connecticut and Rhode Island adopted constitutions. Connecticut finally adopted a constitution in 1818. Prior to that, poor prisoners were required to swear an oath stating their inability to pay their debts, as evidenced by the one page, 6 ¼ x 8 ¼, document offered here. It states, "To Mr. Simeon Capron of Groton on the county of New London, attorney to Nathan Whitmore of Norwood in said county, greeting by authority of the state of Connecticut you are hereby required.to appear at the gaol.on the 15th day of August at 2 o clock in the afternoon.to give reason if any you know why Ebenezer Pelton.should not take the poor prisoners oath which is prescribed by law. To Mr. Isaac Avery of Groton.you are hereby commanded to serve this sitation [citation] on the above named Simeon Capron.4 days before the 15th of August.and return to the same [to] proper authority to have and detaining the same according to Law, dated at Preston, August the 10th day 1789.
