Ein gutes und sauberes Exemplar. - Die Flüchtlingspolitik der Schweiz im Zweiten Weltkrieg beruhte auf der begrifflichen Unterscheidung zwischen politischen Flüchtlingen, welche gemäss Art. 21 des Bundesgesetzes vom 26. März 1931 über Aufenthalt und Niederlassung der Ausländer (ANAG) Asyl erhielten, und anderen Flüchtlingen, darunter namentlich Juden aus Deutschland, Österreich und Osteuropa, denen gegenüber der Spielraum bezüglich Aufnahme oder Abweisung bedeutend grösser war. Ihren Höhepunkt fand diese Unterscheidung in der Anweisung im Kreisschreiben der Polizeiabteilung vom 13. August 1942, illegal einreisende Ausländer mit Ausnahme von entwichenen Kriegsgefangenen, Deserteuren und politischen Flüchtlingen zurückzuweisen, wobei ausdrücklich festgehalten wurde, dass «Flüchtlinge nur aus Rassegründen, z. B. Juden, [.] nicht als politische Flüchtlinge» galten und deshalb der Rückweisung unterlagen. Zwar betonte der Bundesrat, dass auch die Asylgewährung an politische Flüchtlinge im freien Ermessen der Schweiz liege; die begriffliche Unterscheidung zwischen politischen Flüchtlingen, welche laut Gesetz Asyl erhalten konnten, und anderen Flüchtlingen erleichterte aber konzeptionell die Härte gegenüber jüdischen und anderen zivilen Flüchtlingen.
