Entender esse novo universo que representa parte da vida de quase todos os brasileiros, as projeções das identidades na Internet, o trato adequado do patrimônio digital, fazem despertar a consciência da necessidade de tutela jurídica a esses novos tipos de bens e direitos. afinal, a pandemia fez com que se tornasse tênue a separação da vida online da offline - se é que ela ainda existe. Ante a ausência de legislação específica que trate do tema, a tarefa do intérprete é um juízo de adequação aos instrumentos normativos existentes, a fim de se investigar a necessidade de termos leis talhadas para esses bens que, embora possam facilitar a aplicação do arcabouço normativo, podem não ser construídas com a argúcia necessária que os novos ativos requerem. Se as repercussões desses novos bens durante a vida dos seus titulares ainda carecem de estudos, o que dirá seus efeitos  post mortem . O ponto de partida dessa reflexão é a tarefa de delimitar o acervo transmissível pelas regras do Direito Sucessório: todos os dados se transmitem ou apenas aqueles com natureza patrimonial ou dúplice? É dado aos herdeiros conhecer todas as situações jurídicas digitais nas quais o titular da herança está inserido ou faz-se necessário redimensionar a ideia de privacidade, projetando-a para uma tutela  post mortem ? É preciso avançar para além dessas perguntas mesmo elas sendo essenciais para que haja uma base sólida desse instituto jurídico, comumente chamado de Herança Digital a fim de se pensar em efeitos mais específicos que ele gera, formas de avaliação, como deve ser feita sua tributação, se serviços de streaming estão no âmbito do patrimônio transmissível, como qualificar o direito de acesso nessa seara e enfrentar muitos outros problemas em que essa situação jurídica repercute. Foi em razão dessas inquietações que a obra "Herança digital: controvérsias e alternativas" nasceu. Entre outras afinidades, a busca pelas respostas para essas controvérsias uniu as coordenadoras. Por isso, esse projeto foi pensado a partir de problemas que pudessem ser estudados com a maior seriedade por esse time de autores comprometidos com o desenvolvimento de uma dogmática civilista séria, útil e coerente.
