Die erste Ausgabe ist sehr selten. Über KVK konnten wir diese erste Ausgabe nur in vier italienischen Bibliotheken und der Biblioteca Salita dei Frati in Lugano nachweisen, kein Exemplar in einer deutschen Bibliothek. "Alberto de Simoni (3 June 1740 - 31 January 1822) was an Italian lawyer and jurist. (.) In 1763, he assumed the defense of a certain Gabriele Mesmer, accused of simple theft, but facing the death penalty. This prompted Alberto to examine local legal tradition. He gained a local position as a judge, first in Bormio, then Tirano, and in 1773 in Morbegno. Throughout his life, while busy as lawyer and judge, he wrote numerous treatises. (.) in 1776 he published 'Del furto e sua Pena' in Lugano. This work, agreeing that common law was riddled with excessive punishments, modified some of the forceful objections of Cesare Beccaria. In the 1770s, he was welcomed in Milan by the plenipotentiary Count Carlo di Firmian and befriended Gian Rinaldo Carli. In 1783, he published 'Dei delitti considerati nel solo affecto ed attentati' suggesting reform of the criminal statutes, and aligning himself with those who thought laws should aim to deter future crime, not only punish prior acts. (.) Albert moved to Ardenno as a judge in 1799, and in 1802 was named secretary to the Minister of Justice, Buonaventura Spannocchi, of the Italian Republic. He participated, with the support of Count Melzi in an ambitious movement to modernize and codify the legal and criminal code. In the early 19th century, he accumulated a number of honors, including being appointed as member of the National Institute of Sciences, Letters and Arts of Bologna, and was subsequently confirmed in the Royal Italian Institute of Milan. Milano, co'tipi di Giovanni Pirotta, 1823, volumi 2, in-8, brossura d'attesa coeva in carta rosa (mancanza angolare di 5x8 cm. alla copertina anteriore del Tomo II), pp. XII, 272, [2] - 372. Opera di diritto penale che si inserisce pienamente nel dibattito illuminista settecentesco (la prima edizione era infatti del 1776) scatenato da Cesare Beccaria, con cui il De Simoni concordò solo in parte. Lievi gore di umidità.

Etat : Very Good. Paper covered boards. Aside from light wear on front cover (see images), a nice, clean copy with no previous owners' names or other defacements. Scarce. 11.5 x 11.5 in (29 x 29 cm).

Milano, co'tipi di Giovanni Pirotta, 1830, volumi 2, in-8, brossura editoriale rosacea con cornici tipografiche,pp. 224 - 254. De Simoni, giurista lombardo della metà del '700, condivise molto del pensiero illuminista e di Beccaria, distaccandosene però per un approccio più conservatore nei riguardi del diritto romano e del diritto comune. Difetti e piccole mancanze ai dorsi; per il resto buon esemplare, a pieni margini.

Etat : Discreto. In-4° (cm. 19,8), senza legatura, pp. 64 in buono stato (macchia al frontespizio, lievi fioriture sparse). Interessante disquisizione sul matrimonio misto, contro il fanatismo che reputerebbe nulle le nozze tra il nobile cattolico e la nobildonna protestante. Titolo raro e significativo. «Il suo discorso menò gran rumore» [Notizie biografiche sopra Alberto De Simoni, in De Simoni, Saggio sul diritto di natura, Pirotta 1822, p.XII]. «A voi dunque si rivolge egli particolarmente, cari, e fedeli confederati protestanti, che illuminati, e ammaestrati siete abbastanza quanto il fanatismo di religione sia dannoso, e fatale alla pubblica, e privata tranquillità». In-8° (cm. 19), legatura coeva in cartonato d'attesa; pp. 114 [2b] in ottimo stato e in barbe; antica firma di proprietà al contropiatto e strappo ai soli risguardi.Edizione originale del trattato scaturito dall'intervento consultivo del De Simoni nella causa bormiese d'inclusione sociale. «Non solo pretesero d'impedire l'accesso ed ammissione di nuove famiglie [in Bormio], ma di scacciare le già introdotte, che da molti anni vi avevano fissato il loro domicilio» [pp.12-13]. Dedica a Ulisse De Salis. Ottimo esemplare. (SC2-2c).

In-8° (cm. 20,8), brossura coeva in carta decorata (strappetti e piccole mancanze al dorso); pp. XVI 176 in buono stato, in barbe e con testimoni, alcuni deliziosi finalini in legno;prima carta bianca incollata al contropiatto. Edizione originale della famosa ricostruzione storico-giuridica dell'autonomia di Valtellina, Valchiavenna e Val San Giacomo dai Grigioni. Il governo delle Tre Leghe rispose violentemente, istituendo un apposito tribunale per giudicare il De Simoni che dovette così rifugiarsi a Milano. L'epigrafe ciceroniana al verso del frontespizio Desinant aliquando dicere male [.] giustifica l'anonimato in cui tentò di nascondersi l'autore. Cfr. Lozzi II 5804; Melzi II 406. Ottimo esemplare.

Rara opera dello storico e giurista valtellinese (Bormio 1740 - Morbegno 1822) che durante la Repubblica Cisalpina il vicepresidente Melzi incaricò di compilare un codice penale per la nazione italiana. La pubblicazione di questo trattato gli procurò una condanna poichè in esso rivendicava i diritti della propria terra dai Grigioni. Melzi II, 383. Bell'esempl. in barbe. [142].
