One can find both differences and similarities on both of the two thinkers¿ ideas they used for describing the ideal legislator. They both argue that authority should not rest in the hand of just one man, but both give different reasons for this. Machiavelli says that ¿many should remain in charge of the state¿ in order to guarantee stability and make it last long because otherwise there will be whether ¿tyranny¿ or ¿anarchy¿; Rousseau believes that ¿the legislator¿ should not be the sole authority and should not be granted any legislative right in order protect ¿the general will¿ of the people, because otherwise the legislator would ¿be tempted to act according to his ¿private will¿ and destroy the ¿common will¿ (Machiavelli 2012, p.356 & Rousseau 2012, p.572).BoD - Books on Demand, In de Tarpen 42, 22848 Norderstedt 12 pp. Englisch.

Neuware -Seminar paper from the year 2011 in the subject Didactics for the subject English - Pedagogy, Literature Studies, grade: 1,3, University of Paderborn, language: English, abstract: Literature is one of the most important features of the English-as-Foreign-Language-classroom (EFL). It can be taught through different methods and genres. In the course of the seminar we got to know some of these methods which help to design interesting and creative lessons. Since there was the introduction of a certain standard of education in 2003, having the function of improving the culture of learning in secondary schools, it becomes obvious that literary texts are an essential part of the education plan. Education is not seen as retrievable knowledge anymore. It is looked at in its entirety. Therefore, the school should teach pupils to be independent und to develop their own personality. Of course, this also means thinking over the old teaching methods and pay attention to interdisciplinary factors. This aspect is especially important as English - apart from German - can be considered the most important subject concerning the fields of creativity and communication. Additionally, the acquirement of a foreign language leads to intercultural competence, identity formation, change of perspective and tolerance. Thus, it is also particularly literature that pays attention to these goals. In this term paper I will focus on the teaching of novels and their impact on language teaching. For this reason I will firstly answer the questions why literature is important in EFL-classrooms and examine which kind of texts are appropriate for teaching.Afterwards, I will talk briefly about the reception of novels with the help of pre-, while and post-reading phases. Finally, all these theoretical aspects will be part of the last chapter, where the young adult novel ¿Gracey¿ by James Moloney will serve as an example. There will be a lesson outline to demonstrate how the previous points could be put into practice and to display which competences are most acquired and improved.Books on Demand GmbH, Überseering 33, 22297 Hamburg 20 pp. Englisch.

States have been ready to use human rights rhetoric in foreign policy statements and less often to act in ways consonant with those policies. They appropriate the concept of human rights and bent it to serve their own needs. Each state has developed a distinct approach to human rights in its foreign policy. Neuware -Seminar paper from the year 2010 in the subject Law - Miscellaneous, grade: B, New York University School of Law, language: English, abstract: A large number of conflicts relating to international trade are not dealt with by the courts, but instead by arbitration. In a private and informal process, both parties to a contract agree to delegate their issue to a single or a group of unbiased individuals to reach some sort of resolution regarding that issue. International commercial arbitration is one form of arbitration and its use is ever-increasing worldwide for various key reasons. For example, it has the tractability, speed and discretion that standard jurisdictional processes lack . Additionally, it results in an award that is both final and binding and has the ability to be enforced overseas . While the use of ICA is becoming more widespread, particularly in Western European nations where ICA has long been a fixture, Eastern European nations have less faith in ICA, instead opting for alternative jurisdictional processes. This lack of faith has been attributed to a lack of knowledge on the part of such Eastern European nations, thus implying that improved instruction on ICA would be beneficial. The area of ICA has realised some fascinating developments over the years. The interlinked doctrines of kompetenz-kompetenz and separability are brilliant examples of such development. This essay will critically discuss both doctrines and their respective contribution to the development of ICA. This will be done using a range of academic journal articles and textbook chapters and by considering relevant case law and statute.BoD - Books on Demand, In de Tarpen 42, 22848 Norderstedt 16 pp. Englisch.

Neuware -Seminar paper from the year 2011 in the subject Medicine - Hospital Environment, Clinical Medicine, grade: 1,7, Fresenius University of Applied Sciences Köln, language: English, abstract: Increasing cost pressure, shortage of staff, investment backlog ¿ more and more hospitals need to merge with others to survive. Apart from the decreasing capital investments of the federal states, especially the implementation of DRGs (Monopolkommission 2008, 313) and the possibility of integrated health care lead to an enormous cost pressure. In Germany, there is a dual hospital funding. The costs of operation are beared by payments of health insurance funds. Investment costs for new buildings or the replacement of capital goods are payed by the federal states. However, these allowances of investment are on the decrease for years, which leads to investment backlogs in hospital (Augurzky et al. 2009, 93). This implies that hospitals are supposed to invest, but their funds are too small to do so. In the long run, the economic efficiency suffers because it cannot compete with other hospitals regarding the technological progress (Augurzky et al. 2009, 13). The introduction of DRGs [Diagnosis Related Groups], the basis of calculation for hospitals, lead to an increasing pressure of working economically. In the old system, every day of a patient¿s stay in the hospital was refunded based on same-day hospital and nursing charges. In the new system, only occupant days within a predetermined period of hospitalization. The preterm discharge or a discharge exceeding the period of hospitalization results in discounts in payments, which often do not allow cost recovery (Eveslage 2006, 37-39). Accordingly, hospitals are under pressure to treat their patients fast and discharge them within the preset period. This requires efficient and economical operations. An additional burden is the growing competition in the sector of ambulatory care. As a result of the strong medical progress, more and more operations, which were formerly bound to be performed in hospital, can nowadays be done ambulant. Another innovation in the German health care system are medical service centers [Medizinische Versorgungszentren]. They will soon be capable to take over the primary health care in rural areas and replace major hospitals there, because they are able to work more economic (Augurzky et al. 2009, 162). On the whole, the pressure on hospitals increased steadily in the past years. Many hospitals are not capable to assert themselves on the market under today¿s conditions solitary. 12 per cent of the economically weak hospitals are expected to shut down by 2020. (Augurzky et al. 2009, 124).Books on Demand GmbH, Überseering 33, 22297 Hamburg 16 pp. Englisch.

Neuware -Seminar paper from the year 2010 in the subject English Language and Literature Studies - Literature, grade: 1,3, University of Paderborn, language: English, abstract: Families in the 19th century mostly lived in a patriarchal society. Growing up during this time, Mary Shelley used this society ¿ruled or controlled by men¿ as the basis for the population of her novel Frankenstein. On the first sight, the characters appear to fulfill their gender roles perfectly. Women occupy the domestic sphere, men work outside home. In addition, women are only of marginal importance whereas men appear as the strong protagonists who are able to influence the storyline.Even if this first overview is correct, Mary Shelley does not maintain this severe separation of sexes and their characteristics but proves that both women and men own some features of the other sex. Therefore, one could state that the women in Frankenstein have an important role as well, as, at second sight, they share a lot of similarities with men and vice versa which contributes to analyze the topic of androgyny. In my term paper I will therefore concentrate on this androgyny of men and women in Frankenstein. Being androgynous, which can be defined as the state of ¿having both male and female characteristics¿ , is an essential element of the novel. Analyzing the male characters one discovers that the male characteristics are important but that it is especially the femaleness which leads to the course of the novel and not typically male behavior. With regard to women, the androgyny shows the beginning of emancipation and hence, women as contemporary heroines, able to escape from a male-dominated society.Furthermore, it is important to analyze the monster that shows androgynous traits so that it cannot be classified as either male or female. These features show that the monster possesses general human qualities as it shares a lot of similarities with the characters of the novel.Books on Demand GmbH, Überseering 33, 22297 Hamburg 20 pp. Englisch.

Neuware -Seminar paper from the year 2013 in the subject American Studies - Culture and Applied Geography, grade: 1,7, University of Paderborn, language: English, abstract: The African American Civil Rights Movement of the 1950s and 1960s can be seen as one of the major events in Americäs history that fundamentally changed its entire society. In one of the most liberal countries in the world that defeated fascism and fought against communism, people of different ethnicity were still treated differently. While white people enjoyed all the rights, black people were excluded from public places, did not have the right to vote and were punished more severely than their fellow citizens. But the African American population stood up against these kinds of suppression and segregation in the middle of the 20th century and fought for their rights, especially with the help of their leading figures such as Martin Luther King Jr., Rosa Parks and Malcolm X. Even if they could eventually achieve some of their goals such as the abolition of segregated buses or the right to vote, their peaceful movement was most of the times violently stopped by policemen and white civilians.Due to this unequal fight, the blacks¿ demands and sufferings captured more and more the mediäs attention and were documented especially through photography. This photography had a high impact on how the Civil Rights Movement was perceived all over the country and, as a consequence, indirectly helped the protestors in their plans. Interestingly enough, it is remarkable that nearly all these printed photographs show the Movement in a way that was unknown to people so that special emotions towards black people and the own behaviors were evoked: empathy and guilt. This then led to a new debate about racial discrimination and civil rights. In this term paper I will therefore examine in more detail in which way photojournalism supported the African American Civil Rights Movement. I will start by giving a short overview of photojournalism and its effects on society. Then, I will continue by analyzing different types of photographs of the Civil Rights Movement that evoke feelings of empathy and guilt. For this purpose I will describe one exemplary photograph for each category and explain how influenced society. Finally, a conclusion with possibilities to expand the topic will follow.Books on Demand GmbH, Überseering 33, 22297 Hamburg 20 pp. Englisch.

The first one portrays ThomasWentworth, 1st Earl of Strafford (1632) and the second one Lady Anne Carr,Countess of Bedford (1638). Both paintings were painted during the 1630's - theCaroline era - in Britain. Charles I became the king of England in 1625 and one cansay that the first fifteen years of reign were 'remarkably peaceful' even if he reigned without a parliament and only with the help of some confidants inter alia Thomas Wentworth, 1st Earl of Strafford. There were only conflicts in religious matters as Charles I married a catholic woman in Protestant England which caused the first strained relations between the two religious groups. Additionally, the Bishop of London wanted to abolish the Presbyterian Church constitution in Scotland and insert the Anglican Church instead. This led to the Scot's protest and invasion of England. Finally, all these factors unleashed an uprising and the Civil War in the 1640's.Another interesting fact is that the Court of Charles I has been called the 'last Renaissance Court in England [which was] extremely formal, imbued with anatmosphere of elegance and [.] high morality'. Additionally, there was the idea of Platonic Love at Court which came from Italy. Its main notion was 'the transference of the Platonic pattern of divine love to a chosen lady, who was then to be worshipped as the embodiment[!] of highest perfection'.To show all the aims and meanings of van Dyck's portraits I chose a portrait of a man and one of a woman. In both cases I will start by noting my first impressions and then, in a second step, analyse the portrait following a precise scheme. There will be an analysis of the formal aspect and afterwards of the costume, the body and the props used. At the end, there will be a conclusion summarising the most crucial features of van Dyck's courtly portraits.

To achieve a cohesive integration between these three elements it is crucial that the Human Resource department recruits and retains top talented employees to safeguard and promote the culture of the organization. Levi Strauss and Co. is one of the major organizations that value and uphold its corporate culture in an aim of making a difference and history (Levi Strauss & CO., 2013). Talented employees look at various issues before applying to be part of an organizations team. Corporate culture statement is one area that has currently taken significant position and reflects how an employee will react in their work environment how the expectations of the organization. According to Stanford (2011), corporate culture defines the business of the organization, the responsibility of the employees to the shareholders, good corporate citizenship, and boundaries of its operation and interaction with other external environment like government, other companies and various agencies. To attract top talent through corporate culture statements consider placing the employees of the organization first. Neuware -Project Report from the year 2014 in the subject Business economics - Investment and Finance, , language: English, abstract: The phenomenon of ¿Crowdinvesting¿ ¿ a new online means of financing for start-ups and small companies ¿ developed in the USA and is now increasingly taking hold also in Europe and particularly in Germany. By exploiting what is known as the ¿collective intelligence¿ of the crowd of internet users, companies seeking capital are provided with the needed funds. As a return for their monetary contribution, the so-called crowd investors are promised interests and a share in the future value of the company. Throughout 2013, only in Germany about EUR 15 million have been invested via crowdinvesting in a total of 66 business projects. This represents a 250% increase compared with the previous year 2012 . With only a few excep-tions, the projects financed so far via crowdinvesting have been mostly start-ups, mainly in the fields of E-commerce, Commerce and Creative Economy. Whether this form of financing will keep the momentum going and develop into a sustainable and viable funding source de-pends on many different factors. Among those, there is also the future attitude of the banking sector and the State towards granting credits, i.e. funds. Moreover, it remains to be seen, whether crowdinvesting can be a suitable source of funding also for already-established com-panies of the SME sector. A survey carried out by the author in 2013 revealed that the majori-ty of companies already established on the market are not familiar at all with this new online form of financing, yet show interest in it and would be willing to raise capital through this alternative funding method. Still, they would rather use it as a complementary financing com-ponent within a traditional financing mix. Crowdinvesting presents both opportunities and risks. Given the gaps in the current German regulation, companies have the possibility to raise considerably high sums via the internet . The majority of crowdinvesting platforms currently operating on the German market are start-ups themselves and their providers are mostly inex-perienced and do not hold any qualification in the field of Corporate Finance. Furthermore, the platforms¿ suboptimal workflows and structures, along with a lack of compliance policies, do not offer crowd investors the necessary basis to make a safe investment decision. Given the platforms¿ inadequate organizational structures and their unidirectional focus on start-ups, there is a substantial risk that the financed projects will fail already during the crowdinvesting coBoD - Books on Demand, In de Tarpen 42, 22848 Norderstedt 20 pp. Englisch.

Neuware -Seminar paper from the year 2013 in the subject American Studies - Literature, grade: 1,3, Free University of Berlin, language: English, abstract: The 1850 United States Census offered for the first time three options in the category of color: In addition to ¿white¿ and ¿black,¿ the option of ¿mulattö was introduced (Douglas and Yates 44). The idea for this inclusion was forwarded by the northern states of the U.S. as the South was not keen on acknowledging any mixing of the races: A mulatto or mulatta is a child born to one white and one black parent. During slavery, thousands of mulatto children were born to slave mothers and white free men, most often the masters of the women. Due to the one-drop rule (which classified anyone with as little as one drop of African blood as black), these children inherited the race and status from their mothers. In the 1920s, when the author Nella Larsen came to fame, the ¿color line¿ between black and white Americans was drawn more sharply than ever before (cf. Kaplan xv).As mulattoes and mulattas can be of a very light complexion, they are predestined to ¿pass¿ for white. This means that they can cross the constructed color line and live as white people. There are various, widely differing, guesses as to how many mulatto and black people passed in the late 1920s: The numbers range from 5,000 people in the U.S.each year to 75,000 people in only one city per day (cf. Kaplan xv). The concept of passing created two distinct feelings. The fact that people could simply assume another racial identity created fascination, on the one hand, and terror, on the other hand. The two protagonists of Nella Larsen¿sPassing (1929), Irene and Clare, are mulattas. Though they have grown up together, they have made different choices and lead different lives: Clare has passed for white formany years, whereas Irene has stayed within the black community.A detailed comparison shows that these two women do not only represent different options for mulatto people, but that they also share characteristics. As far as character types are concerned, Clare represents the tragic mulatta. Yet Larsen puts forth a revision of this literary tradition and character type. Irene exemplifies the moral black bourgeoisie, though it becomes evident that Larsen distances herself from Irene and the black bourgeoisie¿s morals and ethics. Irene, in addition, also possesses tragic elements. Despite representing different character types, both Irene and Clare are the literary descendants of Iola Leroy, title character of Frances Ellen Watkins Harper¿s novel Iola Leroy; or, Shadows Uplifted.Books on Demand GmbH, Überseering 33, 22297 Hamburg 24 pp. Englisch.

N. Dorall: Conrad and Coppola: Different Centres of Darkness). In his essay The Rethoric of Narrative in Fiction And Film, film critic Seymore Chatman observes that¿a lot of ink has been spilled in recent years on film adaptations of novels (¿). Too much of the discussion has centred on questions of story content, with particular respect to ¿fidelity¿, as if the source novel were some sacrosanct object whose letter as well as spirit the film had to follow.¿He continues that this approach ¿often leads to an unproductive prescriptivism that finds the film inadequate because it does not ¿read¿ like the novel¿. It seems that John Milius and Francis Ford Coppola who both wrote the screenplay for the movie Apocalypse Now, had the same thoughts in mind when they decided to adapt Conrad¿s novel Heart of Darkness -as Milius stated himself ¿ ¿in some shape or form¿. They certainly did not want to spill any ink and he also did not see the novel as a sacrosanct object. Apocalypse Now is not a conventional film adaptation of Conrad¿s novel since -at least at first glance- it does not pay particular respect to ¿fidelity¿; a Vietnam war movie does not seem to have much in common with a novel written in 1898 and dealing with colonialism. However, it is said that HD can be seen as the ¿root¿ for AN, because ¿a seventeen-year old John Milius heard his English reader, Irwin Blackter, extol the splendour of Conrad¿s novel Heart of Darkness¿. And if we take a closer look at the movie, the parallels to Conrad¿s novel become obvious. This essay will be divided into two major parts. The first one of will focus on the comparison of the plot and narrative structure of HD and AN. It will establish a general overview of the formal aspects of novel and film as well as of the similarities of characters appearing in both HD and AN. Special attention will be paid to the symbolic value of the plot of the story- the metaphorical meaning of darkness- appearing in both Conrad¿s novel and Coppoläs movie and the question of how and why the screenplay-writers of AN applied Conrad¿s ideas on their film adaptation. The second part will be with special focus on Coppoläs film adaptation of Conrad¿s novel. The analysis of several scenes will pay special attention to details of techniques for visualisation and sound used by Coppola to depict the plot.BoD - Books on Demand, In de Tarpen 42, 22848 Norderstedt 32 pp. Englisch.

Neuware -Seminar paper from the year 2013 in the subject English Language and Literature Studies - Literature, grade: 1,3, University of Paderborn, language: English, abstract: In the course of the seminar ¿Patricia Duncker¿s Fiction¿ we read, analysed and discussed several works by the British author that all had the similarity of being mysterious, uncanny and captivating. What made these attributes arise was not only the thrilling plot but also the character constellation. Most of the works contain only two or three protagonists and the particularity that the relationship between these protagonists only seems to be harmonious but that is actually based on an unequal balance of power. While one character is superior and dominates the thoughts and actions of the other person, the latter is not able to escape or prevent this inferiority leading to fear, confusion or even death. Interestingly enough, one can state that in Patricia Duncker¿s works this unequal relationship is not arbitrary in reference to sexes but often portrays women as victims and men as offenders. In some cases the victim and the offender are even lovers, which makes it difficult to recognise the offender¿s obsession with the victim from the beginning. Moreover, it is conspicuous that every work contains different types of women¿s victimisation, i.e. manipulation, stalking and violence but that each work clearly focuses on one type in particular. Consequently, all works together contribute to the reader¿s understanding about the range and varieties of this recurring topic. In this term paper I will focus on this victimisation of women in Patricia Duncker¿s works and analyse The Deadly Space Between, The Strange Case of the Composer and His Judge and the short story Stalker in Seven Tales of Sex and Death. At first, I will give a short definition of the term victimisation in a sociological context and explain the above mentioned typical subcategories. Then, I will analyse the focused type of victimisation in the different works in order to show that more than one of the mentioned types of victimisation appear but that one of them always predominates. To understand how the victimisation is carried out I will afterwards also look at the victim¿s introspection and perception by others. In the next step, I will do a short comparison of the victimisation and victims in the different works and finally, as a conclusion, sum up the main findings and give an outlook over further possibilities to expand the topic.Books on Demand GmbH, Überseering 33, 22297 Hamburg 24 pp. Englisch.

For the process of continuous improvement to become successful, it is necessary for an organization to have good feedback mechanisms where customers¿ preferences are evaluated according to the goals that a company has. Organizations use Kaizen principle to ensure success in their operations. These principles introduce continuous improvement in the culture of a company, quality of products and services, technology, safety, productivity and leadership. Using Kaizen system, employees from every level of management are given a chance of suggesting the techniques that an organization can adopt in order to improve its entire operations. Continuous improvements benefit an organization in several ways. One of the benefits of this strategy is that it helps in reducing all the wastes that may be in organization¿s processes. It also improves the quality of organization¿s products increasing the level of consumers¿ satisfaction.Customers¿ satisfaction focuses on the extent at which consumers are happy concerning services and products that are offered by a particular business. The level of consumer satisfaction is used to assess the efficiency of employees in an organization. All the employees should be trained so that they attend to all the needs of consumers. Being polite to customers drives the sales of a company. Due to this, companies are able to achieve the profits targeted by focusing on consumer satisfaction. Conducting customers¿ surveys is one of the methods that companies use to determine whether consumers are satisfied with the services offered to them. From the surveys, a company is able to assess its chances of having return customers. Such surveys also enable firms to know whether they have met or exceeded the expectation of consumers. Firms use the calculated customers¿ satisfaction levels to assess the purchase intentions of consumers. It enables firms to project the market share that they will have. All marketing efforts should be directed towards increasing the level of satisfaction of consumers. It will enable organizations to increase their brand loyalty.Books on Demand GmbH, Überseering 33, 22297 Hamburg 40 pp. Englisch.

The German as well as the American economy seemed to be both very successful over the last decade in terms of GDP growth. Although both economies are successful, their financial systems differ widely. While the American system is strongly capital market-based, banks play the dominant role in the German financial system. As it was for a long time a purely bank-based system, it represented a unique financial system around the world. In this paper, I will point out the main features of the traditional German financial system. I will mainly focus on the role and structure of the financial sector, financing patterns of firms, and the German corporate governance system. So far, most academic literature has concentrated on the peculiarities of the ¿old¿ German financial system. In the following paper, recent developments will also be included. Major changes and trends of the German financial system since the begin-nings of the 2000s will be outlined, leading to the question if the system underwent a process of transformation from a bank-based to a capital market-based financial system.I will begin with a brief summary of the basic definitions, concepts and classifications that are necessary to describe and analyze the German financial system. In chapter 3, the ¿old¿ German financial system, called an international prototype of a bank-based system, is outlined. After ex-plaining the main elements of the ¿old¿ German financial system focusing on the financial sector, financing patterns of firms and the corporate governance system, recent changes and develop-ments since the 2000s will follow in chapter 4. Within chapter 4, the current state of the German financial system will be described with an emphasis on developments that could have led to a transformation to a capital market-based system. This description leads to the conclusion in chapter 5 that the German financial system has not transformed to capital market-based system and kept its unique peculiarities but is no longer a purely bank-based financial system.Books on Demand GmbH, Überseering 33, 22297 Hamburg 24 pp. Englisch.

This is attributed to poor communication skills from management. Good communication is needed so that employee commitment and productivity is enhanced. Successful managers must not view themselves as only bosses, but as performance role models. Effective communication will enhance a culture where employees will openly voice out their views in building the organization. In this paper I am going to look at how leaders in a healthcare organization can communicate effectively so that staff, and particularly the nursing staff is developed and the healthcare organization is transformed to higher productivity.Books on Demand GmbH, Überseering 33, 22297 Hamburg 24 pp. Englisch.

F., strategies help to predict the impact of current decisions (and decisions not made) on the future of an organization. If one decides strategically he has always the problem to set the course, without knowing all he would need to know. The problem of knowledge deficit can never be solved completely, because strategic decisions concern the future. The relationships and interdependencies in a globally networked economy are much too complex and they change too fast. Nevertheless, the managers today have a number of tools that help them to see where the journey is heading. Relevant changes and developments should be recognized, that have already begun, but by superficial observation remain hidden and without appropriate consequences. Such changes must be systematically detected and analysed in the strategy process. Derived measures must be planned and implemented consistently. The main objective of this paper is to describe, which tools private and public companies use to develop a strategy successfully and in which sequence of steps they should be used.Books on Demand GmbH, Überseering 33, 22297 Hamburg 40 pp. Englisch.

BoD - Books on Demand, In de Tarpen 42, 22848 Norderstedt 52 pp. Englisch.
