En el presente estudio, Marmor muestra cómo surgió este interés a partir de la «teoría semántica del derecho», introducida por Dworkin, que cambió en buena medida el panorama tradicional de la concepción del derecho. Comparando las posiciones anteriores, por ejemplo de Hart, con las de Dworkin y sus partidarios, el autor reconstruye en un diferenciado análisis crítico este cambio metodológico y sus principales consecuencias. La cuestión del «sentido» de la ley y de su interpretación, así como la ambigüedad de ciertos casos legales exigen una precisión de lo que debe ser el consenso sobre las «condiciones de la validez del derecho». Examinando el concepto de interpretación de Dworkin y sus bases epistemológicas, Marmor descubre una serie de incoherencias lógicas que pueden llevar a la teoría y la práctica del derecho a un relativismo peligroso que, en realidad, resulta innecesario desde el punto de vista lógico y lingüístico. Con el argumento de que la interpretación no es más que un recurso de excepción dentro de la concepción estándar del lenguaje y de la comunicación, Marmor defiende que la interpretación sólo afecta los aspectos de la comprensión insuficientemente determinados por las leyes y convenciones respectivas.
