Édition originale peu courante de cet ouvrage de jurisprudence d'Ancien Régime qui fut l'une… des sources du Code civil. Une seconde édition paraît en 1770 , remaniée et augmentée par le fils de l'auteur. Au XVIe siècle, Charles du Moulin, stimulé par un mouvement de rédaction et réformation des coutumes, propose de les comparer afin d'en extraire des « règles générales » applicables à l'ensemble du royaume. Suivant cette première impulsion, la question du droit national ? réunissant notamment coutume et législation royale ? continue de préoccuper les juristes des XVIIe et XVIIIe siècles dans un contexte de foisonnement des jurisprudences encyclopédiques. Comme du Moulin puis Claude-Joseph de Ferrière (Nouvelle institution coutumière), Bourjon propose de dégager un « droit commun » de l'étude des coutumes, en particulier de la coutume de Paris ; toutefois la synthèse qu'il réalise avec Le droit commun de la France englobe également des éléments de droit canon, de droit romain, des arrêts et ordonnances royales ainsi que des notions de droit naturel. Comme le souligne Renée Martinage Baranger, l'ouvrage de Bourjon, autant par contenu que par son style, influença les rédacteurs du Code civil (Bourjon et le Code civil, 1971). « Toute personne est libre, s'il n'y a Loi ou Jugement contraire ; les troubles des siècles d'ignorance ont pu seuls dénier cette justice à l'humanité. Tel est le Droit Commun de la France. Heureuse la terre où cette maxime est inviolablement observée ! » (p. 1). Indication manuscrite « Redresser » à l'encre à la p. 656 du vol. 1, où les caractères sont en effet mal alignés.
